Minutes 09-27-32 SPECIAL NE~TING OF SEPTEMBER 2V, 1932. A Special Meeting of the Board of Town Commissioners of the Town of Boynton was held at the Tow~ Hall om Tuesday even~, September 2V, 1952 at V:30 o'clock P.M. Present; H. D. Stevens, Mayor Frank Nutting, Vice-Mayor J. P. Bowen, Towr~ Clerk. The above constituting the entire Board of Town ~ommissioner of the Town of Boynton, Florida. This meeting was called for the p,o~pose of taking any a~d all actio~ in the division of the TOE aEi to transact any other business that might come before the Commission. After a lemgth~ diseussiom Commissioner Nutt~im~ made a motiom that the following Resolution be passed and adopted: R.ESOT.UT ION WHEREAS, under~ the amendment to the city charter of t he Town of Boston enacted by Chapter 15056 of the Acts of 1931 amd by the charter of the Town of Boynton Beash enacted by Chapter 15088 of the Acts of 1931, it was provided that the Town of Boymton Beach should assume and discharge fifty percent, of all lawful indebtedness of th~ Tow~ of Boy, ton, whether evidenced by bonds or otherwise for which the Town of Boynton was obligated on the first of April, A.D. 1930, provided said Imdebtedness should be credited with the amount theretofore or thereafte~ collected by the town from the State Road Department, a~d the existing Town of Boynton should be liable for and discharge the remainder of said indebtedness; WHEREAS, it was further provided by the charter of the Town of Boynton Beach that the Town of Boynton Beach was declarei to be the lawful o'~ner amd emtitled to possession of all tax sal~ certificates smd assessment liems them outstanding i~corporati~g amy property located with~the boundaries ~f the Town of Boynto~. Beach, smd was also the owner ~d entitled to possessio~ of all taxes paid on aw property toeated within the boundaries of the Town of Boyntom Beach paid after Jamuary 1, l~l,and was also declared to be the owner smd entitled to possessio~ of the lien for amy u~paid taxes lawfully levied a~d assessed a~ai~st smy properties located within tbs boumdarles of the Tow~ of BoyntOn Beach and was authorized to collect the same; a~d Wh~R~ both towns by said acts were authorized to refund the outstanding indebtedness; smd ~HEREAS it is necessary that the Town of Boy. tom Beach should have the information necessary to enable it to assume said imdebteduess smd to ¢otlect the taxes, certificates, assessments and other items title and possessio~ of which was vested in it: NOW, THEreFORE. BE IT RESOL¥~D B~£ THE TOWN COMMISSION OF THE TOWN OF BOYNTON THAT the Town Clerk of the Town of Boynton do hereby deliver to the Town of Boyntom Beach a scedule duly c~tified to by him as being a coercer schedule, which shall show the following information: 1. The amount o~b~onds of th~ Town of Boynto~ which were outstanding 9n-April 1, 1930, givi~ date of issue, rate of i~terest, dates total amount then outstanding or unpaid, whether due or not due. The amount of past due bonds of each issue Which were outstanding and unpaid as of April l, 19~0. Amount of unpaid coupons upo~ any and all of said issues which were past due as of Ap~iI 1, A.D. l~O: and the amount now outst~udimg a~d unpaid and owi~g by the Town of Boynton. The amount of Judgements which had been entered agair~t the Town of Boynton as of April 1, 19~0 and wb-ich were unpaid, together with the interest which had accrued upon the same as of that date and any credits received a~d applicable to the same sLuce April 1, 1~0, together with the total amount now due amd ~m~ owi~ amd u~paid on said judgement s. Certificates of indebtedness which had been issued by the Town of Boynton on p~operties located within the boundaries of th~ Tovea of Boynton Beach showing the date of said certificates, the rate of interest, property covered by same. Amount of any note or notes which were owin~ or unpaid by the Town of Boynton as of April 1, 19~0 showing the name of payee, rate of interest, when du~ and payable. Amount of money and all other indebtedness which was owing by the Town of Boynton, whether represented by open account or otherwise, as of April l, 1~0, with a list showing the names of the creditors, amount of the indebtedness ~ s/so any ~ all ~t~ a~Justments wh/ch h~ve beea m~e on s~ ~c~bs the TOE Of ~nto~ s~oe s~id 8. A list of all liens for special assessments w~ch ~ve been levied by the To~ of B~nton p~operty located ~t~n the bo~daries of the T~n of B~nton Beach for ~v~ or othe~ ~provements includi~ the date of the lie~s, ~ate of ~temest s~e should be~, description of t~ p~per~ agalns~ w~ch the lien was levied, ~o~t of liens ~d ~turity date of lO. A statement showi~ the ~ou~t of t~es which had been collected by the To~ of Boston between January l, lg31 and June l, located in the Town of Boynton Beaoh.~ BE IT ~URTNER RE~OLVED that the Town Clerk is hereby authorized to permit the duly accredited representative~f the Town of Boynton Beach to have access to any of the records of the Tow~ of Boynton for the purpose of verifying the infc~matiom sc furnished, or obtain such additional imfo~matien f~m the records of the Town of Boynton as m~y be needed. BE iT FURTHER RESOLVED that this Co~nission does hereby auhtorize the transfer and assignment to the Town of Boynton Beach of all tax sale certificates which had been issued by the Town of Boynton on property located within the boundaries of the Town of Boynton Beach prior to April 1, 19~0, said asstgmment and t~ansfer to be without recourse upon the To~ of Boynton. BE IT FORTBER RESOLVED: that the Tow~ Clerk is hereby authorized and instructed to prepare and state an account between the Tov~ of Boynton and the Tomu~ of Boynton Beach so as to show any balance or balances which may be owing from one Town to the other, and to report the results of such statement to thi~ Commission for further action. BE IT FUP~HEE RESOLVED that the said To~n Clerk is hereb2 authorized to take any action and to do any and all things that may be necessary to carry into effect the provisions of the charter act of the Town of Boynton Beach ~ud the amendment to the charter of the Town of Boynton insofar as they relate to the division of the assess and liabilities of the Town of Boynton. This motion was seconded by Commissioner Bowe~ and upon being put tca vote, the following vote was had thereon: 19~1 upon properties · ~ "AYE" Comm~ss ~oner Stevens Commi ,AYE" Upon motion made by Commissioner Stevens, sd¢onded ~y Commissioner Nutting and duly carried, the Deputy Clerk was auhtorized and instructed to credit the amount of One Humd~ed Sixteen Dollars Seventy Fou~ Cents ($116.V4) on the water bill of M~. J. J. Killeen and to charge same against CREDIT DUE on account of paving assessment paid in full. ~. W. P. Somerville, in behalf of the Boynton Bondholder,s Committee, presented a~d requested payment of fifty past due eoupons amounting to Fifteen Hundred Dollars ($1,§00.00) from the Interest and Sinking F~nd.
