Minutes 06-09-33SPECIAL ~ETING OF JUNE A Special Meeting of the Board of Team Co~mmissioners of the T~vn of Boynton, Florida, was held at the Town Hall on Friday afternoon June 9, 1933, at ~:00 o~o!ock p. ~, Present: H.D. ~tevens, ~yor ~m. Menzel, Vice Mayor J. P. BOwen,~ Town Clerk. The above constituting the entire Board of Town Com- missioners of the Town of Boynton, Flor~dao This Meeting was called for the purpose of discussing the m~tter of t~ issuance of Refunding Bonds bea~ing a lower rate of interest aud extending the tim~ of payment of the in- debtedness to be exchs~uged for a corresponding release of the outstanding obligations of the Town of Boynton~and any other matters that might come before the Eeet~_ug. Commissioner Stevens moved the adoption of the ~ollow- lng Resolution: ~H~EA~, the To~.~ Co~ission of the To~ of Boynton~ ~lorida, has under consideration the issuance of Ref~muding Bon~s for the purpose of funding or refunding that portion of the outstsnding indebtedness of the existing Town of Boynton~ Florida, both principal and interest apportioned to the Town of Boynton, Florida, under the provisions of sn Act Incorpor- ating the To~n o~ Boynton Beach, passed at the 1931 Session of the ~egislature of the State of Florida, which indebted- ness includes the following: 1~ ~Refunding, V~ater Works and Street Bonds~ dated October l, 19~3, bearing Luterest at six per centum per annum~ mat%tring serially, of which issue there is outstandi~ and un- paid $3~00o00 in the prinoip~ amount, together with overdue and accrued interest amountir~ to 2~ ~Improvement Bonds,~ dated October 1, 19~, bearing interest at six per eentumperannum, mmtu~ing serially, oF which issue there is outstanding ~dunpaid $80,000.00 in prin- cipal amount, together with overdue and accrued interest am. ount- ing to 8. ~Improvement Bonds, Issue of June 1, 1926," dated Ju~e I, 1926, ~bearing interest ab six per bent~m per annum matuFing serially of ~hich issue there is outstanding unpamd $23~500.00 in principal ~nount, t~gether wi th overdu~ and accrued i~.ter~st amountmng to 4. mImprovement Bonds, Issue of 1926 1926, bearing, interest at six per centum per ar~uum, maturing serially, of w~ich issue there is outstanding ~d unpaid $66,S00.00 in princi~l mnount, together v~th overdue ~d accrued interest amounting to §. mRe~nding Bonds, Series B,~ dated 0ctobe~ !, 1928, bearing interest at six per centum pe~ annum, maturir~ serially, of w~zich issue there is outst~ding ~nd unpaid $1~V~000~00 in principal amount, together with overdue ~d mccrued interest amounting to 6. "Judgement entered in the United States District Court in and for the ~outhern District of Florida, ~iaz~t Divi- sion, Case No. !380-M Civil, in favor of the ~.~zite Construction Company against the Town of Boyntonunder date of November 29th, 1929, which Judgement bears interest at eight per oentum per ~r~uum, the principal amount of said judgement being $11~,84~.~5 together with overdue and accrued interest in the s~ of $28,886.40. V. "Certificates of I debtedness dated May l, 1928, bearing interest at eight per C~ntum per ~nttm, maturing in ten equal a~ual installments, of which mssue ~e~e' is ou~- standing and ~&upaid $28,882.23 in ~ri~cipal amount, together with overdue and accrued interest in ~he sum of $6,963.33. and~ '~R~EAS, it is the desire of the Town Co~mission, of the Town of Boynton, ~orida, that it obtain ~ opinion approving the validity and legality of all Resolutions, Ordinances, Notices and other proceedings in connection with the aforesaid Refunding Bo~o NOV~ THEREFORE BE iT ~SOLVE~ by the Board of Town Com- missioners of the ToE of Boynton~ Florida, that Messrs. Caldv~l! "& R~ymond, Bond Attorneys of ll8 Broadway, New Y~k~ N. Y, be employed for the purpose of rendering ~u approving opinion in respect to the vslidity and t~ g~li~ty of all proceed- frogs in connection therewith° This motion was seconded by Co~ssloner Menzel and up- on beir~ put to a vote, the following vote was ~d thereon: Aye Commissioner Stevens, ~Aye~ Commissioner ~enzel, Commissioner Bowen, ~Aye~ Stevens moved the adoption of the following Co~nissioner Resolution: Messrs. Caldwell the Town of Boynton is lawfully indebted to ~ Raymond, Bond Attorneys of Il8 Braodway, New York, N. Y. in the s~ of $2,~0~.81 for professional ser- vices heret~oPe r&ndered in conncetion with the issuance sale of various issues of Tow~ of Boynton Bonds. And, ¥~EAS, in the judgement of the Board of Town Cormnis- sioners of the Town o£ Boynton, Florida, it will be for the bes~ interest of said Town as well as for the best interest for the Taxpayers of said town to liquidate or pay the indebted- ness due Messrs. Caldwell & Raymond, by the Town of Boynton, Florida, by the issuance of Bonds provided Messrs. Caldwell & Raymond will accept such bonds in full satisfaction ~,wi release of their claim, N0~ TP~P~0RE BE IT RESOL¥~ by the Board of Town Com- missioners of the Town of Boynton, Florida, that ~m. Somerville be a~d he hereby is authorized to call upon ~essrs. Caldwell & Ray:mend of 118 Braodway, New York, N. Y. for the purpose of ascertainir~ if they will accept ~nding or Re- funding Bonds of the Tov~ of Boynton, in the sum of $2,500.00 and cash in the sum of $4..81 in full satisfaction and release of their claim against the Town of Boynton, for ~rofessional services heretofore rendered. P. Somerville to call ,upon certain creditors of the Town of Boyn- ton in an endeavor to reduce the ~mount of their claim. In the event that Mr. Somerville is successful he shall be paid the s~m of Two Hundred ~ Fifty (4250.00) Dollars to defray D_is expenses, the said sum to be paid from taxes levied for the year 19~3, and collected during the month of November 1933.
