19-1248 CITY OF BOYNTON BEACH, FLORIDA CASE NO. 19-1248 CITY OF BOYNTON BEACH, Petitioner, vs. MARC CHARLES AND MIMONDE CHARLES Respondent(s) ORDER IMPOSING PENALTIES/LIEN THIS CAUSE came before a public hearing before the Special Magistrate of the City of Boynton Beach, Florida on November 20, 2019, after due notice to the Respondent(s), at which time the Magistrate heard testimony under oath, received evidence, and issued its findings of fact and conclusions of law and thereupon issued its oral order which was reduced to writing and furnished to the Respondent(s). Said Order required the Respondent(s)to take certain corrective action by the time certain, as more specifically set forth in that Order with a compliance date of September 30, 2019. Under oath, the Code Officer testified to the Magistrate that the required corrective action was not taken as ordered. This case did comply. Accordingly, it having been brought to the Magistrate's attention that the Respondent(s) did not comply with the Order dated 8/28/19 hereby ORDERED that Respondent(s) pay to the City of Boynton Beach, Florida, a fine in the amount of twenty-five dollars ($25.00) per day for the violation(s) that exist at 128 SE 27th Way, Boynton Beach, Florida, more fully described as: Lot 13, Block 6 of Seacrest Estates, according to the Plat thereof, as recorded in Plat Book 24, Page 245, Public Records of Palm Beach County, Florida. PCN: 08-43-45-33-08-006-0130 At the fine certification hearing, the Special Magistrate certified an accrued fine in the amount of$700.00 plus administrative costs of$634.12 for a total of$1,334.12. THIS MATTER came before the Community Standards Special Magistrate for hearing on the 21sT DAY OF AUGUST, 2019. After considering the testimony and evidence the Magistrate finds: 1. Respondent(s)owns the Property,which is the subject of this Magistrate proceeding. 2. A violation or violations existing on the Property as set forth in the Notice of Violation is/are as follows: CO CH15 SEC. 15-120(D)1 D and CH14 SEC. 14-3. 3. The Respondent(s)has/have been properly provided with Notice of Hearing and no one appeared at the hearing. It is therefore, ORDERED AND ADJUDGED THAT: 1. Respondent(s)shall correct the violation(s)by September 30,2019. 2. If the Respondent(s)will not comply with this Order,a fine in the amount of$25.00 is imposed each day the violation(s)exist(s) past the date set for compliance or for each time the violation(s)has/have been repeated.Additionally,administrative costs of $634.12 is now assessed. 3.
