WHEREAS, the City Council of the Ci~/ of Boynton Beach, Florida, deems it
~ecessary and advisable for the public peace, safeR and general welfare of the
inhabitants and citizens of the said City to limit the hours of any building
construction, commercial, industria.l or manufacturing operation of certain
machinery or equipment within the said City;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF nE CITY OF BOYNTON
BEACH, FLORIDA:
Section I: That Subsection t7-22.2 (i) of Chapter 17 of the Codified
Ordinances of the City of Boynton Beach, Florida, is hereby amended to read
as follows:
"(i)
To carry on within the City any commercial, industrial
or manufacturing operation between the hours of 7:00
P.M. and 8:00 A.M. in such a manner that the noise of
such commercial, industrial or manufac~uring activity
will be heard beyond the premises of the cc~amercial,
industrial or manufacturing establishment whereon ~such
activity is carried on."
Section 2: That Section 17=22.2 of Chapter 17 of the Codified Ordinances
of the City of Boynton Beach, Florida, is hereby amended by adding Subsection
(j) which shall read as follows:
The erection (including excavation), demolition, alter-
ation or repair of any building, or the operation of any
pile driver, steam shovel, pneumatic hammer, bulldozer,
c~a~e, ~fragline, tractor, derrick, steam er electric hoist,
road building equipment, or other equipment, other than
between the hours of 8:00 A.M. and 7:00 P.M. on any weekday,
including Saturday, provided such weekday is not a legal
holiday."
Section 3: ~.uthority to Codify: Specific authori~/ is hereby granted to
codify and incorporate this Ordinance in the City's existing code.
Section 4: Separability: Each of the provisions of this Ordinance are
separable, including word, clause, phrase or sentence, and i~ any portion
thereof shall be declared invalid, the remaining portion shell not be affected
but shall remain in full force and effect.
Section 5] ~: All ordinances or parts of ordinances
in conf] itt herewith are hereby repealed.
