AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING CHAPTER 29 OF T~E CODIFIED
ORDINANCES OF ~SAID CITY BY ADDING ADDITIONA~
S~UB-SECTION~~ TO SCHEDULE VIII OF SECTION 29-2
TO PROVIDE ~OR THE PROHIBITIOb~ OF CER~IAIN
VEHICLES ON CERTAIN STREETS; PROVIDING FOR
AUTHORITY TO CODIFY, SAVINGS CLAUSE, RE'PEA~ING
PROVISIONS, AN EFFECTIVE DATE AND FOR OTHER
PURPOSES.
WHEREAS, in the interest of providing for greater traffic
safety and providing for proper control of tr~ffic~icongestion
upon the streets in the City of Boynton Beach, Florida, the
City Council of said City deems it necessary and advisable to
prohibit the operation of certain motor vehicles on certain
streets zn said City;
NOW~ THEREFORE, HE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BOYNTO~ BEACH, FLORIDA:
Section 1: Chapter 29 of the Codified Ordinances of the
City Of Boynton Beach, Florida~ be and is hereby amended by
adding sub-section (3), together with the sub-paragraphs there-
under, to Schedule VIII of Section 29-2, which sub-section (3),
together with the sub-paragraphs thereunder, shall read as
follows:
~'(3) State Road No. 5~ State Road No. 804t and Congress
Avenue are designated as 'primary routes'. All other
streets in the City of Boynton B~ach are designated as
'secondary routes'. For the purposes of this sub-
section (3), together with the sub-paragraphs thereunder,
all motor vehicles in excess of 3/4~ ton pick-up, not
including passenger cars, shall hereinafter be referred
to as ~trucks'.
(a) Truoks passing through the City without a
destination in the City shall use only primary routes.
(b) Trucks with a point of origin within the City
limits and a destination outside the City limits shall
proceed from the point of origin to the closest primary
or secondaz~ route and proceed along priw~ry or secondary
routes to the City limits.
~(c) Trucks entering the City from outside the City
and going to any destination within the City shall use
only primary or secondary routes to the ~losest point of
destination.
(d) A truck with a point of orig~n inside the City
limits and a destination inside the City limits (and this
includes a situation in which a truck from outside the City
limits has made a delivery in the City and is in the process
of making subsequent deliveries within the~Cit~) shall
proceed from the point of origin to the closest primary
or secondary route and proceed along primary or secondary
routes to the closest point to the point of destination.
(e) Trucks of any goverlnmental agsncy or franchised
public services corporations (Florida Power and Light
Company, Southern Bell Telephone and ~Telegraph Company,
and Florida Public Utilities Company~ are excluded from
the operation of this sub-sectien (3).
(f) The city Manager is~ directed forthwith to procure
such number of signs indicating '~P~imary Truck Route' as
he deems necessary to designate such routes. ~e is directed
further to post such signs at, all e~trances to the City
and to post such signs at appropriate intervals on such
routes.
(g) The City Manager shall, upon the recommendation
of the City Engineer, post on any other street in the City
signs bearing the following language: 'No Through Trucks'
(h) The Finance Director is directed to mail, by
certified mail return receipt requested, to all firms
licensed to do business within the City, a copy of this
ordinance. Upon return of the receipt, the Finance
Director shall notify the Police Chief of the completion
of notification. If $ driver of a truck owned by any
such firm~is found to be in violation of this ordinance
after such notification, he shall be guilty of the offense
hereinafter provided for.
Ii) If~ after the effective date of this ordinance,
the driver of a truck owned by any firm not notified as
provided in sub-paragraph (h) above is in violation of th is
sub-section, such driver shall be issued an appropriate
warning. Upon a subsequent violation by a driver of a
vehicle owned by an owner so notified, such driver shall
be guilty of the offense hereinafter provided for.

Any person who violates any provision of this
shall be punished in accordance with the terms of
1-6 of this Code of Ordinances.
(k) Temporary truck routes may be established by the
City Engineer; and the City Manager shall post the standard
'Primary Truck Route' sign with an attachment designating
'Temporary'. "

Section 2: AUTHORITY TO CODIFY: Specific authority is
hereby granted to codify and incorporate this Ordinance in the
City's existing Code~
~ection 3: ~EPARAB~LIT~: Each of the provisions of this
Ordinance are separable, including word, clause, phrase or
sentence, and if any portion thereof shall be declared invalid,
the remaining portion shall not be affected but shall remain in
full force and effect.
Section 4: REPEALING PROVISIONS: All ordinances or parts
of ordinances in conflict herewith are hereby repealed.
~Dction 5: A~ EFFECTIVE DATE: This Ordinance shall become
effective in the manner and at the time provided by.law.
