PREAMBLE
WHEREAS, the penetration of fire w~lls and fire breaks
with materials non-equivalent to fire ratings of walls or
breaks which are penetrated presents a danger to the public
health and welfare; and
WHEREAS, the City Council of the City of Boynton Beach,
Florida~ deerms the passage of this Ordinance necessary and
advisable to provide for the immediate preservation of public
property, health and safety;
NOW, THEREFORE ~ BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA:
Section 1: Chapter 12 of the Codified Ordinances of the
City of Boynton Beach, Florida, be and is hereby amended by
adding thereto an additional section to be know~ as Section 12-36
which shall read as follow~:
"Section 12-36. Penetration of Fire Walls mhd Fire Breaks.
Any material penetrating a fire break or fire w~ll
shall have the equivalent fire rating of that break or
w~ll which is penetrated."
Section 2: AUTHORITY RD CODIFY: Specific authority is
here]0y granted to codify and incorporate this Ordinance in the
City's existing Code.
Section 3: SEPARABILITY: Each of the provisions of this
Ordinance are separable, including word, clause~ phrase or
sentence~ and if any port-ion thereof shall~be~declared invalid,
the remaining portion shall not be affected but shall remain in
full force and effect.
Section 4: REPEALING ~ROVISIONS.. All ordinances or
of ordinances in conflict herewith are hereby repealed.
