O73-39ORDINANCE NQ. 73-39 AN ORDINANCE OF TIlE CITY OF BOYt~TON BEACH, FLORIDA, AMEBYDING SECTION 26-5 OF Cl]APTER 26 OF T~E CODIFIED oRDiNANCES OF SAID CITY, T~ PROVIDE FOR AN AMEiqDMENTOF TItE MUNICIPAL EXISE TAXES OF SAID CtTY~ PROVIDING FOR AU- tHORITY TO CODIFY, SAVINGS CLAUSE, REPEALING PROVISIONS, AN- EFFECTIVE DATE AND FOR OTHER PURPOSES. WHEREAS, the City Council of the City of BoYnton Beach, Florida, deerms it to be necessary and advisable to amend the mun ic ipa 1 CITY OF BOYNTON BEACH, FLORIDA: pgction 1: That Section 26-5 Ordinances of the City of Boynton Beach, by amended to read as fellows excise taxes of said city as hereinafter provided; Tt/~REFORE, BE IT ORDAII~ED BY THE CITY COUNCIL OF THE of Chapter 26 of the Codified Florida, be and is here- "Section 26-5. There is hereby levied by the city on each and every purchase in the city of electricity, metere~ or bottled gas (natural, liquified petroleum gas, or manufactured), and local telephone service, a tax based upon the charge made by the seller thereof, said tax to be at the rate of 6 1/2% upon said charges, which tax~ shall in every case, be P~id by the purchaser, for the use of the city, to the seller of such elec- tricity, gas, or telephone service at the time of pay- lng the charge therefor, to the seller thereof, but not less often than monthly. Established churches located within the municipal limits of the City of .Boynton Beach, Florida, are hereby specifically exempt from imposition and payment of the taxes hereinabove established." Each of the provisions of this Ordinance are separable, including word, clause, phrase or sentence, and if any portion thereof shall 1~ declared invalid, the remaining portion shall not be affected but shall remain in full force and effect. Section 4: ~pealinq Provisions: All ordinances or parts of ordinanees in conflict herewith are hereby repealed.
