O73-38ORDINANCE NO. 73-~ AN ORDINANCE OF THE CITY OF BOYNTON BEACHa FLORIDA, AMENDING CHAPTER 31 OF THE CODIFIED ORDINANCES OF SAID CITY BY AMENDING SECTION 31-10 BY PROVIDING~ FOR SPECIFIC PERMITTED USES AND PROHIBITED USES UNDER M-1 INDUSTRIAL DISTRICT ZONING CLASSIFICATION; I~ROVIDING FOR AUTHORITY TO CODIFY, SA~I~GS CLAUSE, REPEALING PROVISIONS, AN EFFECTI~vE~DATE ~ND FOR oTHER PURPOSES. ~REAS.~ the City Council of the City of Boynton Beach, i!Florida~, deems it necessary and advisable to provide for more il' specific uses to be permitted and to be prohibited under the M-1 industrial district zoning classification; and W~EREAS, the Planning and Zoning Board of the City of Boynton Beach has recommended to the City Council the uses to be permitted and to be prohibited under said zoning classification; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: 1. S~ction. l: Chapter 31 of the Codified Ordinances of the City of Boynton Beach~ Florida~ be and is hereby amended amending Section 31-10 to read as follows: "Section 31-10. M-1 Industrial District. (A) USES PERMITTED. Within any M-1 Industrial District~ no building~ structure~ land or w~ter~ or part thereof shall be erected~ altered or used~ or premises used~ in whole or in part, for other than one or more of the following specified uses: (l) Any use permitted in C-2 General Commercial District. (2) Other permitted uses: (a) Manufacture, processing and distribution of the following: Appliances (small) Bakery goods Boats Beverages Confection Cosmetics Dairy products Dry ice Electronic equipment Food products Furniture Glass products Gasoline and oil products - distribution only Leather goods excluding tanning and processing M~tal products - ~light) Millwork and lumber Precision instruments Textiles and clothing Tires - excluding manufacturing Tobacco products ~b) Certain Industrial uses: Contractors' storage yards (open) Commercial radio-microwave transmission stations Dry cleaning and laundry plants Engraving, printing shops and publishing Garages - parking, storage and repairs Machine shops Moving and storage warehouses Open s~orage yards Public ~utilities operations Warehouses Welding shops USES PROB~IBITED. Brick, concrete and cement product manufacture Concrete ready mix plants Dyeing plants Fertilizer plants Junk and salvage yards Oil refineries Residences and trailer parks Sanitary land fill Smelting and casting operations (C) BUILDING HEIGHT. See Section 31-10.1. (D) YARD REGULATIONS. None, except when the side of a lot abuts a residential district, there shall be a side yard of not less than thirty (30) feet on that Side. (E) OFF-STREET PARKI~IG REGULATIONS. See Section 31-13.~' Section 2: Authority to Codify: Specific authority zs hereby granted to codify and incorporate this Ordinance in the City's existing Code. Section 3: Separability: Each of the provisions of this Ordinance are separable, including word, clause, phrase or sentence, and if any portion thereof shall be declared invalid, the remaining portion shall not be affected but shall remain in full force and effect. - 2 Section 4: Re pealinq Provisions: of ordinances in conflict herewith Section 5: An Effectiv~ Date: effective in the manner and at the Ail ordinances or parts are hereby repealed. This Ordinance shall become time provided in the Charter and Ordinances of the City of Boynton Beach, Florida. First reading this ~ day of August, 1973.
