AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA~
AMENDING C~APTER 25 OF THE CODIFIED ORDINANCES OF
SAID CITY BY, ADDING AN ADDITIONAL SECTION AND PRO-
VIDING FOR PAYMENT BY DEVELOPERS AND/~R PROPERT~
O~NERS FOR COSTS OF ALTERIbTG MEDIAN STRIPS TO FACIL-
itATE INGRESS A~ND EGR~ESS~; PROVIDING FOR AUTHORITY

EFFECTIVE DATE AND FOR OTRER PURPOSES.
~K4EREAS~ in omderto provide ingress and egress for land
development projects presently under construction er to be con-
structed in the future, alterations of median strips to provide
for additional turning and holding la,es shall from time to time
be deemed by the City Council to be necessary for certain of
such projects for the promotion and protection of the health~
safety and ~eneral welfare of the community; and
WHEREAS~ the City Council of the City of Boynton Beach deems
it necessary and advisable to provide for the costs of such median
strip alterations to be borne by the developers and/or property
owners whose land development projects shall create the need for
such median strip alterations;
NOW, THEREFOREg BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH~ FLORIDA:
1. Section 1: Chapteri25 of the Codified Ordinances of the
City of Boynton Beach, Florida~ be and is hereby amended by adding
thereto an additional section to be kno~ as Section 25-13 which
shall read as follows:
"Section 25-13. Alterations Gf Median Strips.
(1) Whenever alterations of median strips to provide
for turning and/or holding lanes to facilitate ingress and
egress for land development projects vghich are presently
under construction or to be constructed in the future are
deemed necessary by the City Council for the promotion and
protection of the health~ safety and general welfare of the
community~ the costs for such alterations shall be borne
and paid for by the developers and/or property owners of such
land development projects°
(2) In all cases the developers and/or property owners
shall submit one hundred per cent (100%) ~erformance .end
completion ~ond guaranteeing the construction of and payment
for all such median strip alterations°
(3) Whenever such alterations of median strips are
deemed necessary by the City Council as aforesaid, no
building permit shall be issued for the construction of
any building ~ structure or other development of property
unless the Plans~ and specifications for such median strip
alterations have been approved by the Florida State Depart-
ment of Transportation and by the City's ~olice Chief~ Fire
Chief~ Building~ Official. and City Engineer, and unless the
develoPers and/or property owners shall have submitte~ the
Perf°rma~ce~nd'~J0mple~ion ~ond as aferesai~do"
2. ~ut~o?ity toCodi~v: Specifi~ .authority ishereby,
granted to codify and incorporate this Ordinance in the City's
existing Code.
3. ~: Each of the provisions of this Ordinance
are separab~e~ including word, clause~ phrase or sentence~ and
if any portion thereof shall be declared invalid~ the remaining
portion ~hall no~ be affected but shall remain in full force
and effect.
4. Repealinq Provi~ions: Ail ordinances or parts of
ordinances in conflict herewith are hereby repealed.
5. An effective date: This Ordinance shall become effec-
tive in the manner and at the time provided in the Charter and
Ordinances of the City of Boynton Beach, Florida.
