R99-162RESOLUTION R99-/~,,¢~' A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING EXECUTION OF AN ENGINEERING SERVICES WORK AUTHORIZATION, BETWEEN THE CITY OF BOYNTON BEACH AND CAMP, DRESSER & McKEE, INC., TO PROVIDE FOR PREPARATION AND SUBMITTAL OF A THIRD ANNUAL NPDES REPORT, ATTENDANCE AT MONTHLY MEETINGS HELD BY THE LEAD PERMITTEE AND PROGRAM COORDINATION; PROVIDING AUTHORITY TO THE CITY MANAGER TO EXECUTE THE AUTHORIZATION AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City entered into an Agreement for Professional Services with Camp, Dresser & McKee, Inc., on December 16, 1991, hereinafter %greement"; and WHEREAS, the AGREEMENT contemplated continuing engineering consulting services in conjunction with the development of a master storm water management program; and WHEREAS, Camp, Dresser & McKee, Inc., have submitted a proposal to ~ssist the City in complying with requirements for Year Three of the Palm Beach 3ounty NPDES permit; and NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF rilE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. The City Commission hereby confirms the foregoing ~vhereas clauses are true and correct findings of the Commission necessary to support this Resolution. Section 2. The City Commission does hereby authorize the City Vlanager to execute an Engineering Services Work Authorization between the City and Camp, Dresser & McKee, Inc., a copy of which is attached hereto as Exhibit "A". DATE: I. PROJECT DESCRIPTION Il. III. Assist the City in complying with requirements for Year Three of the Palm Beach County NPDES permit. This includes preparation and submittal of a third annual NPDES report, attendance at monthly meetings held by the lead permittee, and program coordination. CONTRACT REFERENCE This Work Authorization shall be performed under the terms and conditions described within the Master Agreement for Stormwater Utility Projects dated the 16th day of December, 1991, by and between the City of Boynton Beach and Camp Dresser & McKee Inc. SCOPE OF SERVICES IV. Attached herewith are the Scope of Services and Exhibits A through D which detail the work effort for this Work Authorization, PROJECT STATUS REVIEW Vo The Engineer shall provide the City with a complete draft copy of the third annual NPDES report for review. PROJECT SCHEDULE AND DELIVERABLES The Engineer shall commence services immediately upon authorization and complete services requested by the City within a period of twelve months from receipt of written Notice to Proceed. The schedule for completion of the NPDES draft report is April 30, 2000, with the final report due on July 8, 2000. The completion of the NPDES report versions by these dates is predicated on receiving data from the City by February 28, 2000. VI. CONSULTING ENGINEER INSURANCE REQUIREMENTS A. Workers' Compensation Insurance in accordance with Florida Statutes. M10381 1 B. Comprehensive Automotive Liability with a minimum coverage of $1,000,000 annual aggregate for bodily injury or accidental death. C. Comprehensive General Liability with a minimum limit of $1,000,000 annual aggregate coveting property damage. D. Liability for Property Damage, while operating a motor vehicle, with minimum limits of $1,000,000 annual aggregate. E. Contractual Liability including limits established for Items VI B., C., and D. above. F. Professional Liability with minimum limits of $1,000,000 annual aggregate. VII. COMPENSATION FOR SERVICES VIII. The total amount to be paid to the Engineer by the City of Boynton Beach under this Work Authorization for the services associated with Tasks 1 through 4 shall be on an upper limit basis of $22,380. The Engineer will invoice the City on a monthly basis on a percentage co[npletion basis as required for payment. This fee estimate assumes that the City will provide electronic versions of the previous annual report. Exhibits B through D detail the Budget Estimate for Tasks 1 through 4. TERMINATION This Work Authorization may be terminated by the City, upon thirty (30) days written notice to the Other party. If terminated, the Engineer shall complete, and shall be paid for, services rendered through the date of termination. (CDM) to assist the City in developing a Stormwater Master Plan, assist the City in complying with an Environmental Protection Agency (EPA) National PollUtant Discharge Elimination System (NPDES) Municipal Separate Storm Sewer System (MS4) permit, and assist in the implementation of facilities and funding. The City of Boynton Beach is a co-permittee on the Palm Beach County NPDES permit along with forty other municipalities and agencies. The effective date of Permit No. FLS 000018 is February 1, 1997. Pa~t of the permit requirements stipulate that annual reports be submitted that provide information on the portion of the MS4 for which they are the operator. This information includes an overall evaluation of the Stormwater Management Program, a summary table that documents the program activities and compliance status, a narrative report describing in detail the program activities and compliance status, and a discussion of the monitoring and fiscal program. The City has submitted reports to fulfill their Year One and Year Two requirements and has asked CDM to assist in developing the NPDES report for Year Three of the permit. It has also been requested that CDM represent the City at monthly NPDES steering committee meetings and assist in program coordination. SCOPE OF WORK CDM will assist the City in the following Preparation of the third annual NPDES report Response to EPA review comments Attendance at monthly meetings of co-permittees Program coordination T~kl.0 Preparation of third annual NPDES report CDM will prepare the City's section of the NPDES third annual report as a component of the overall document for Palm Beach County. CDM will meet with City personnel to itemize information needed from the City for the report. The City will provide pertinent information to CDM including the second annual NPDES report, maintenance records, inspection forms and logs, stormwater best management practice implementation, standard operating procedures, interlocal agreements, and City ordinances. All of the information collected will be eValuated and a draft third annual NPDES report will be developed in a format consistent with the MS4 permit. The report will include: · · · · · · · · Contacts List Stormwater Management Plan (SWMP) EvaluatiOn Summary Table Narrative Report Monitoring Summary of SWMP and Monitoring Modifications Fiscal Analysis Appendices The draft report will be submitted to the City for review. CDM will meet with the City to discuss their review comments. The review comments will be incorporated into the final draft version of the report which will be submitted to the lead permittee. CDM will discuss with and respond to the review comments,of lead permittee. Five hard copies of the fmal report will be submitted to the lead permittee. Two copies of the fmal report will be provided to the City for their records. Task 2.0 Response to EPA review comments CDM will respond to comments received from the EPA and the Florida Department of Environmental Protection (FDEP) on the sections of the third annual report that pertain to the City. The upper limit labor estimate for these efforts is 40 hours. If additional services are required to address review comments, the upper limit may be amended based on mutual consent of the City and CDM. Task 3.0 Attend Monthly Co-Permittee Meetings CDM will attend monthly meetings held by the lead permittee to discuss issues related to Palm Beach County NPDES permit compliance. CDM will attend up to twelve meetings and will provide a monthly summary to the City on the issues discussed at the meetings. Task 4.0 Program Coordination CDM will provide assistance to the City with miscellaneous tasks related to permit compliance. These activities may include responding to information requests from the lead permittee, EPA, and FDEP; assisting the City with compliance with permit conditions; and assisting the Utilities Department in coordinating NPDES requirements with other City departments. The upper limit labor estimate is based on 60 hours of services under this task.
