O73-12ORDINANCE NO. 73 -/~ ~H OPd}INANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, LEVYING SPECIAL ASSESSMENTS AGAINST PROPERTY BENE- FITED BY A CERTAIN STREET IMPROVEMENT PROJECT WITHIN THE SAID CITY, TO WIT: CONSTRUCTION OF APPROXIMATELY 550 FEET OF ROADWAY ON N. W. 5th STREET BETWEEN N. W~ 10th AVENUE AND N. W. 12th AVENUE, RECITING BY WHAT METHOD SAID SPECIAL ASSESSMENT IS MADE AND THE TIME WHEN S~ME SHALL BECOME PAYABLE, PROVIDING FOR THE METHOD 0P COLLECTION THEREOF, AND FOR OTHER PURPOSES. WHEREAS, pursuant to the provisions of Section 160 of the Charter of the CITY OF BOYNTON BEACH, FLORIDA, the City has heretofore caused a certsin public street t¢ be constructed over the property more particularly described as: CONSTRUCTION OF APPROXIMATELY 5S0 PEET OF ROADWAY ON N. W. 5th STREET BETWEEN N. W. 10th AVENIiE AND N. W. 12th AVENUE, and WHEREAS, the City Clerk has hezetofore compiled sn assessment roll showing the lots and land assessed to pay the cost thereof in 2on- nection with subject impFovement~ and the amounv of assessment as to each such lot or land~ which said roll has heretofore been approved by the City 2ouncil; and WHEREAS~ proper legal notice of the approval of said roll has been given and a public hearing held relative thereto~ at which time no objections were made~ }r if objections were made, same were deemed insufficient by the City Council; NOW~ THEREPORE~ BE IT ORDAINED BY THE CITY COUNCIL OP THE CITY OF BOYNTON BEACH~ FLORIDA: Section 1: That the special a~sessmant roll covering the above-described project, a true copy of which is attached hereto and hereby made a part hereof~ is hereby ratifiad~ approved and confi~med~ and the amounts indicated for each lot or parcel described therein are hereby Levied ~gainst same as a special improvement and same shall constitute liens against said land as of the effective date of this Ordinance, each of said parcels along subjec~ improvement having }een ~ssessed on a front footage basis~ charging each parcel its propor- :ionate share by dividing its respective front footage into the to,al .mprovemenE cost. Section 2: Each property owner shall have the privilege of )eying the entire assessment as to his property within ninety (90) days from the attachment of said improvement lien without penalty. If any ~wner fails to pay said lien within said ninety (90) day period, it shall be paid in three eonsecutive equal installments, payable as other ad valorem taxes are paid~ con~encing with year 1973, together with aterest at the rate of 8% per a~num from the date of attachment of said lien on the unpaid balance thereof. Section 3: Each of the provisions of this OrdiRance are ~eparable, including word, clause~ phrase, or senrence~ and if any )ortion hereof shall be declared invalid, the remaining p~tion shall ~ot be affected, but shall remain in full force and effect. Section 4: REPEALING PROVISIONS: All ordinances or parts Df ordinances in conflict herewith are hereby repealed. SECTION 5: EFFECTIVE DATE: This Ordinance shall become effective in the manner and at the time provided in the Charter and )rdinanees of the City of Boynton Beach, Florida.
