R 01 ~ :~ la[ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF BOYNTON BEACH AND PALM BEACH COUNTY, TAX COLLECTOR, PROVDING FOR THE COLLECTION AND ENFORCEMENT OF NON-AD VALOREM ASSESSMENTS; AND PROX~DING AN EFFECTiVE DATE. WHEREAS, staff has recommended approval of an Interlocal Agreement between the City of Boynton Beach and Palm Beach County Tax Collector for the collection of its non-ad valorem assessments pursuant to the uniform method for the levy, collection and enforcement of non-ad valorem assessments as provided for in Section 197.3632 Florida Statutes. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1 The Mayor and City Clerk are hereby authorized to executo an 2nterlocal Agreement between the City of Boynton Beach and Palm Beach County Tax Collector. which Agreement is attached hereto as Exhibit "A". CITY OF BOYNTON BEACH, FLORDA V' yo ~  commissioner Commissioner AGREEMENT THIS AGREEMENT made and entered into this ~ day 2001 by and between Jetta K~ Clark, as Tax Collector for Palm Beach County, and the City of Boynton Beacl~ for the implementation and collection of the City's non-ad valorem assessment billing as follows: The City of Boynton Beach shall meet all the requirements of Florida Statutes 197.3631 and 197.3632 for the implementation of the City's non-ad valorem assessment billing. Upon the performance by the City of Boynton Beach of the reqmrements of the above statutes and this Agreement, the Tax Collector agrees to implement the City's non-ad valorem assessment billing and collection. The City of Boynton Beach further agrees that it shall provide to the Tax Collector compensation for the actual cost of collecting this non-ad valorem assessment as provided in Florida Statutes. (F.S. Section 197.3632 (8) (C). Since the actual costs of collection cannot be precisely determined, the parties agree that one percent (1%) of total collections will be considered the costs. Tkis Agreement shall be in effect for the tax year 2002 and subsequent years thereafter unless canceled by either the City or the Tax Collector by giving notice in writing to the other by January 10th. This Agreement may be modified by both parties in writing provided such modifications are agreed upon prior to any notice of termination. This Agreement shall be changed, modified or amended in writing as necessary to conform with any new statutory requirements when and if enacted into law. DATED this 14 day of "~r.~_~n~e- 2001.
