A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA,
SUPPORTING THE MUNICIPAL PUBLIC SAFETY
COMMUNICATIONS CONSORTIUM
COMMUNICATIONS PROJECT; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Section 163.01 o£the Florida Statutes, known as the Florida Interlocal
Cooperation Act of 1969, authorizes local governmental units to make the most efficient use
of their powers by enabling them to cooperate with other localities on a basis of mutual
advantage and thereby and thereby m provide services and facilities in a mariner and pursuant
[o forms of governmental organizations that will accord best with geographic, economic,
population and other factors influencing the needs and development of local communities;
and
WHEREAS, it has been determined that the plarming and development of an
mmroperable Countywide municipal public safety communications system will allow
municipal public safety agencies to improve their provision of public safety services by virtue
~f enhanced inter-agency comm~mications and cooperation; and
WltEREAS, the Municipal Public Safety Communications Consortium (MPSCC)
~vas formed through the cooperative efforts of the various municipalities with the support of
.he Criminal Justice Commission to plan and imple~rnent an interoperable Countywide
municipal public safety radio communications and cooperation; and
WHEREAS, the City of Boynton Beach has joined 23 other mumclpalities located
~vitkin Pall Beach County to form the MPSCC and the City has long been involved with
efforts to improve public safety communications; and
WItEREAS, the MPSCC, through the diligent efforts of it's member municipalities
has developed a plan for a municipal countywide interoperable communications system; and
WHEREAS, the MPSCC communications plan has been approved by the State of
Florida office of Technology as required by Florida Statute 282.111 (5); and
WHEREAS, the Criminal Justice Commission has budgeted federal grant funds to
assist the MPSCC with its initial adrrfinistration costs for the current fiscal year; and
WHEREAS, Section 318.21(10), Florida Statutes permits any county which
mrticipates in an intergovernmental radio communications program approved by the State of
florida Department of Management Services to use $12.50 from each moving traffic
violation to fund that county's participation in the program, and
WI-IEREAS, a portion of the revenues collected are from violations which are written
~y municipal law enfomement officers within the municipal limits, and
WHEREAS~ the Board of County Commissioners allocated a portion of the revenues
enerated by municipalities for their benefit under Resolution R99-2343 to encourage the
~teroperability of municipal communications systems and therefore enhancing the County's
Intergovernmental Communications Plan; and
WHEREAS, the Criminal Justice Commission, after reviewing the MPSCC
communications plan, recommends to the Board of County Commissioners that the MPSCC
communications network be made a part of the Palm Beach County Intergovernmental
'.ommunications Program as an enhancement to the plan; and
WHEREAS, the Criminal Justice Commission is requesting on behalf of the MPSCC
that the previously approved resolution be clarified by amendment to reflect the current needs
of the MPSCC in order to implement is communications project.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1. That the municipality of Boynton Beach, by and through its City
Commisson, formally supports the Municipal Public Safety COmmunications Consortium
MPSCC) public safety communications plan.
Section 2. The City of Boynton Beach supports the inclusion of the MPSCC
:ommunications plan as an enhancement to the State approved Palm Beach County
intergovernmental radio communications program plan.
Section 3. The City of Boynton Beach requests that the County provide the use of
the municipal portion of the $12.50 traffic fine monies for construction of the radio system as
recommended by the Criminal Justice Commission and the MPSCC in their proposed
a-nendment to resolution R99-2343, and that the federal grant fimds already allocated for the
2onsortium's adrrdnistration be transferred for use by the MPSCC.
Section 4. That this Resolution shall become effective immediately upon passage.
