A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOYNTON 8EACH, FLORIDA,
AUTHORIZING AND DIRECTING THE MAYOR AND
CITY CLERK TO EXECUTE A CONTRACT BETWEEN
THE CITY OF BOYNTON BEACH AND THE SCHOOL
BOARD OF PALM BEACH COUNTY TO PROVIDE
SCHOOL BUS USE FOR SUMMER DAY CAMPS; A
COPY OF SAID CONTRACT IS ATTACHED HERETO
AS EXHIBIT "A"; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, each year the City of Boynton Beach contracts
ith the Palm Beach County School Board for use of their
ruses to transport children in our summer Day Camps and
~laygrounds; and
WHEREAS, the City Commission of the City of Boynton
~each has deemed it to be in the best interests of the
~itizens and residents of this City to approve said contract
)ased upon their review and upon recommendation of staff.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
)F THE CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1. The City Commission of the City of Boynton
~each, Florida hereby authorizes and directs the Mayor and
~ity Clerk to execute the Contract between the City of
toynton Beach and Palm Beach County School Board, which
:ontract is attached hereto as Exhibit

This agreement, made and entered into this day of
3une , 1992, by and between the SCHOOL BOARD OF PALM
BEACH COUNTY, FLORIDA, a public school corporation herein referred
~o as "BOARD" and The City of Boynton Beach
a political subdivision of the State of Florida, hereinafter
referred to as the ". City
Whereas the "BOARD" owns and opera=es school buses and whereas
the "BOARD" recognizes the need on occasion, for other parties no
utilize those buses to provide opportunities of a recrea5ional
nature for the c~ildren of Bovnton Beach S,,m~r Day Camp Pro~ram
1. Provision of Buses
The "BOARD" agrees to provide school buses and drivers
for trips organized and supervised by
.the City of Boynton Beach Recreation Depar~ment/St~mm,r Day Camp
( government en~ity) during the time period of
June 22, 1992 , and August 14~ 1992
The City agrees to fully
compensate the BOARD for these bus trips. These costs
include the driver's salary at Twenty (20) dollars per
hour and charge of }1.00 per mile.
3. Liability Insuranc~
The City (government entity) agrees to
provide the "BOARD" with a certificate of insurance
naming the "BOARD" as an additional insured on the
City (government entity's) automobile
liability insurance policy with regard to the 'BOARD'S"
buses. If the C{ty (government entity)
elects to self-insure the liabilities under paragraph 4,
the City (government entity) agrees to
provide the "Board" with written acknowledgement that
these liabilities will be covered by the self-insurance
plan.
4. Indemnification (As required by 234.211(2)(a))
The city (government entity) shall
indemnify and hold harmless the "BOARD" from any and all
liability, claims, lawsuits, damages and expenses
(including attorney fees) related to loss of life, bodily
injury, property damage (including loss of u'se thereof)
directly or indirectly caused by, resulting from, arising
out of or occurring in connection with the use of such
buses per this agreement.
This paragraph is authorized by Chapter 234.211 and is
subject to Chapter 768.28 of Florida Statutes.
5. Damaqes to School Buses in Use Pursuant co This A~reemenr
The City (government entity) agrees
to be responsible for accidental damages to the "BOARD'S"
school bus directly or indirectly caused by, resulting
from, arising out of or occurring in connection with the
use of the buses.
6. Responsibility
The requesting government entity shall be solely
responsible for planning for the safety and well being
of those being transported.
7 Procedure for Re~uestina Use of School Buses
Ail requests for the use of school buses by goverr~ent
entities will be initiated in writing and directed to ths
principal (or his/her designee) for community education
at a' local community school. After the aforementioned
conditions have been met, the assistant principal for
community education will forward the request to the
Transportation Department. The money to finance the
trips must flow from the governmen~ entity to requesting
school to the Transportation Department.
This agreement shall become effective upon official
approval of both parties.
