20-017 1 2 ORDINANCE NO. 20-017 3 4 5 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA 6 AMENDING THE LAND DEVELOPMENT REGULATIONS 7 CHAPTER 3 "ZONING",ARTICLE III, "ZONING DISTRICTS AND 8 OVERLAYS", SECTIONS 1.B. AND 2.E., TO SET A CONSISTENT 9 MAXIMUM BUILDING HEIGHT FOR ALL SINGLE-FAMILY,AND 10 SINGLE AND TWO-FAMILY RESIDENTIAL ZONING DISTRICTS; 11 PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION 12 AND AN EFFECTIVE DATE. 13 14 15 WHEREAS, Staff recommends changing the maximum allowable building height 16 for the R-2 zoning district from 25 feet to 30 feet to achieve consistency with the single- 17 family zoning districts; and 18 WHEREAS, maximum building height for a single family home in the single 19 family zoning districts was increased from 25 feet to 30 feet in the 1990's; and 20 WHEREAS, it was an oversight that the R-2 district was excluded from this 21 amendment as single-family homes are allowed within the R-2 district, and therefore, single 22 family homes and duplexes should be regulated uniformly; and 23 WHEREAS, the City Commission of the City of Boynton Beach has considered the 24 recommendations and has determined that it is in the best interest of the citizens and residents 25 of the City of Boynton Beach, Florida to approve the amendments to the Land Development :46 Regulations as contained herein. 27 NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF ;8 THE CITY OF BOYNTON BEACH,FLORIDA,THAT: 29 Section 1. The foregoing whereas clauses are true and correct and are now ratified 30 and confirmed by the City Commission. 31 Section 2. City of Boynton Beach Land Development Regulations, Chapter 3, 32 "Zoning", Article III, "Zoning Districts and Overlays", Sections 1.B. and 2.E., to set a 1 S:\CA\Ordinances\LDR Changes\LDR Amendment (Ch 3 CDRV 20-002XHeight) -Ordinance.Docx 33 consistent maximum building height for all Single-Family, and Single and Two-Family 34 residential zoning districts are hereby amended as follows: 35 See Exhibit "A" attached hereto and made a part hereof 36 Section 3. Each and every other provision of the Land Development Regulations 37 not herein specifically amended, shall remain in full force and effect as originally adopted. 38 Section 4. All laws and ordinances applying to the City of Boynton Beach in 39 conflict with any provisions of this ordinance are hereby repealed. 40 Section 5. Should any section or provision of this Ordinance or any portion 41 thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not 42 affect the remainder of this Ordinance. 43 Section 6. Authority is hereby given to codify this Ordinance. 44 Section 7.
