20-019 1 2 ORDINANCE NO. 20-019 3 4 5 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, 6 FLORIDA AMENDING THE LAND DEVELOPMENT 7 REGULATIONS CHAPTER 3 "ZONING", ARTICLE IV, "USE 8 REGULATIONS," SECTION 3.D. USE MATRIX, TO REVISE 9 THE LOCATIONAL CRITERIA AND REGULATIONS FOR 0 AUTOMOBILE RENTAL; PROVIDING FOR CONFLICTS, 1 SEVERABILITY, CODIFICATION AND AN EFFECTIVE 2 DATE. 3 4 5 WHEREAS, in order to address a recognized need to provide greater flexibility in the 6 locational criteria for the siting of automobile rental businesses, and fulfill the needs of the 7 City's growing population, staff proposes adding this use to additional zoning categories, 8 creating a series of operational criteria (including the requirement that they be located on 9 properties at major road intersections),and requiring Conditional Use approval of any outdoor 0 vehicle storage on site; and 1 WHEREAS, the City Commission of the City of Boynton Beach has considered the 2 recommendations and has determined that it is in the best interest of the citizens and residents 3 of the City of Boynton Beach, Florida to approve the amendments to the Land Development 4 Regulations as contained herein. 5 NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF 6 THE CITY OF BOYNTON BEACH,FLORIDA, THAT: 7 Section 1. The foregoing whereas clauses are true and correct and are now ratified 8 and confirmed by the City Commission. 9 Section 2. City of Boynton Beach Land Development Regulations, Chapter 3, 0 "Zoning", Article IV. Use Regulations, Section 3.D. Each and every other provision of the Land Development Regulations 34 not herein specifically amended, shall remain in full force and effect as originally adopted. 35 Section 4. All laws and ordinances applying to the City of Boynton Beach in 36 conflict with any provisions of this ordinance are hereby repealed. 37 Section 5. Should any section or provision of this Ordinance or any portion 38 thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not 39 affect the remainder of this Ordinance. 40 Section 6. Authority is hereby given to codify this Ordinance. 41 Section 7. A maximum of 20 vehicles may be stored in these marked stalls. An additional amount, up to another 20 vehicles, may be allowed within service areas or non- circulation areas of the site, if determined by staff to be feasible and non-detrimental to service and emergency operations, as well as general vehicular circulation. No required landscaping shall be removed to accommodate the supplemental parking area; (c) Vehicle Maintenance. No fueling or servicing of automobiles shall be permitted on- site. Car washing and vacuuming may be allowed if conducted in a service area not visible from any right-of-way, or if located within a fully enclosed building; (d) Pre-existing Uses.Any pre-existing and licensed Automobile Rental establishment will not be considered non-conforming and may apply to increase their rental inventory through the Conditional Use process. b. All rental vehicles must be located within marked stalls and only in parking spaces in excess of the minimum required parking spaces for the site/use(s). Said spaces shall be marked for the sole use of the rental operation only. (f) Vehicle Maintenance. No fueling or servicing of automobiles shall be permitted on-site.
