20-020 1 2 ORDINANCE NO. 20-020 3 4 5 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, 6 FLORIDA AMENDING THE LAND DEVELOPMENT 7 REGULATIONS CHAPTER 3 "ZONING", ARTICLE IV, "USE 8 REGULATIONS," SECTION 3.D. USE MATRIX, TO ALLOW 9 PROFESSIONAL AND TECHNICAL SCHOOLS IN 0 INDUSTRIAL (I) PODS WITHIN QUANTUM PARK; 1 PROVIDING FOR CONFLICTS, SEVERABILITY, 2 CODIFICATION AND AN EFFECTIVE DATE. 3 4 5 WHEREAS, this amendment would expand the permitted locations for Professional 6 and Technical Schools within the PID (Planned Industrial District) to lots that have an 7 Industrial (I) land use option within Quantum Park; and 8 WHEREAS, the City Commission of the City of Boynton Beach has considered the 9 recommendations and has determined that it is in the best interest of the citizens and residents 0 of the City of Boynton Beach, Florida to approve the amendments to the Land Development 1 Regulations as contained herein. 2 NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF 3 THE CITY OF BOYNTON BEACH, FLORIDA,THAT: 4 Section 1. The foregoing whereas clauses are true and correct and are now ratified 5 and confirmed by the City Commission. 6 Section 2. City of Boynton Beach Land Development Regulations, Chapter 3, 7 "Zoning", Article IV, Use Regulations, Section 3.D. Use Matrix, to allow professional and 8 technical schools in Industrial (I)pods within Quantum Park is hereby amended as follows: 9 See Exhibit "A" attached hereto and made a part hereof 0 Section 3. Each and every other provision of the Land Development Regulations 1 not herein specifically amended, shall remain in full force and effect as originally adopted. 2 Section 4. All laws and ordinances applying to the City of Boynton Beach in l S:\CA\Ordinances\LDR Changes\LDR Amendment (Ch 3 CDRV 20-002XSchools) -Ordinance.Docx 33 conflict with any provisions of this ordinance are hereby repealed. 34 Section 5. Should any section or provision of this Ordinance or any portion 35 thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not 36 affect the remainder of this Ordinance. 37 Section 6. Authority is hereby given to codify this Ordinance. 38 Section 7. General Note.This use is allowed within the PID,except that if proposed in Quantum Park,it shall be restricted to a lot that has an Industrial(I)land use option. 27. General Note.This non-industrial use is allowed within the PID district provided it is located on a lot that has a Mixed Use(MU)land use option fronting on an arterial roadway or on a MU lot with a development order that is not solely for residential development. 31. General Note.This non-industrial use is allowed within the PID district provided it is located on a lot that has an Office(0)land use option.No drive-through facility shall be allowed in connection with this use.
