R92-23RESOLUTION NO. R92-~ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, APPROVING AN AGREEMENT BETWEEN THE UNITED STATES DEPARTMENT OF JUSTICE, DRUG ENFORCEMENT ADMINISTRATION AND THE BOYNTON BEACH POLICE DEPARTMENT; AUTHORIZING AND DIRECTING THE MAYOR AND CHIEF OF POLICE TO EXECUTE SAID AGREEMENT WHICH iS ATTACHED HERETO AS EXHIBIT "A"; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the U.S. Department of Justice, Drug Enforcement ~dministration (DEA) has a resident office location in West Palm Beach, Florida; and WHEREAS, the DEA has established a Task Force to combat the trafficking of narcotics and other dangerous drugs; and WHEREAS, it is deemed to be in the best interests of the City of Boynton Beach to authorize its police department to participate in this Task Force pursuant to the terms and conditions outlined in the attached Agreement annexed hereto as Exhibit "A". NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA THAT: Section '1. The attached State and Local Task Force Agreem--~ ~bit "A") is hereby approved and the Mayor and Chief of Police are hereby authorized to sign and enter into this Agreement on behalf of the City of Boynton Beach, Florida. The BBPD acknowledges that this agreement will not take effect and no Federal funds will be awarded to the BBPD by DEA until the completed certification is received. 12. The BBPD agrees that an authorized officer or employee will execute and return to DEA the attached OJP FORM 4061/3, Certification Regarding Drug-Free WOrkplace Requirements. The BBPD acknowledges that this agreement will not take effect and no Federal funds will be awarded to the BBPD by DEA until the completed certification is received. 13. When issuing statements, press releases, requests for proposals, bid solicitations, and other documents describing projects or pro,rams funded in whole or in part with Federal money, the BBPD shall clearly state: (1) the percentage of the total cost of the program or project which will be financed with Federal money and (2) the dollar amount of Federal funds for the project or program. 14. The term of this agreement shall be from the date of signature by representatives of both parties to September 30, 1992. This ag=~ment may be terminated by either party on thirty days advance written notice. Billings for all outstanding obligations must be received by DEA within 90 days of the date of terminationofthis agreement. DEA will be responsible only for obligations incurred by BBPD during the term of this agreement.
