R91-/Sq A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING ADMINISTRATIVE ACTION TO PROCESS WATER AND SEWER SERVICE AGREEMENTS FOR THE TRADEWIND ESTATES SUBDIVISION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Boynton Beach, Florida upon recommendation of staff, deems it to be in the best interest of the citizens and residents of the City of Boynton Beach to authorize administrative action to process water and sewer service agreements for the Tradewind Estates Subdivision. NOW~ THEREFORE, BE IT RESOLVED.BY THE CITY COMMISSION OF THE CITY OF ~oyNToN BEACH, FLORIDA THAT. Section 1. The Mayor and City Clerk are hereby directed to execute an Interlocal Agreement between the City of Boynton Beach and Palm Beach County, said Agreement being attached hereto as Exhibit "A". Section 2. The Utilities Director is hereby authorized to sign-off on the plans and applications for the water and sewer systems serving the Tradewind Estates Subdivision. Section 3. The City Commission hereby approves water and sewer service to ali parcels encompassed by the Tradewind Estates Subdivision, on the condition that each landowner submit an executed agreement for water service, with all supporting documents, prior to being connected. The COUNTY agrees to: A. Advertise for bids, submit bids to the CITY for approval, and award a contract for the construction of infrastructure improvements, including water distributions, sewage collection and/or transmission systems which are to be owned by the CITY. B. Administer the above contract and administer the funds in accordance with this Agreement provided, however, that City's inspector will review and approve all pay requests for the water distribution main along U.S. 1, South of Turner Road prior %o payment to the utility contractor. C. Supply the City with a contract audit in accordance with standard accounting procedures which reflect total, final costs of the water distribution main along U.S. 1, South of Turner Road upon completion of this project. D. Reimburse or credit the City for the labor and materials required which re-pumps the area, in an amount to upgrade lift station No. 409 sewage flows from the subject not to exceed $10,000. The CITY agrees to: A. Provide or cause to be performed ali inspection services for the construction of the water distribution, sewage collection and/or transmission systems during construction of the aforementioned water and sewer systems. B. To contribute and to forward to the COUNTY the funding for the actual costs of construction of approximately 1200 L.F. of water distribution main along U.S. l, South of Turner Road, plus 1/2 of ths associated restoration cost. Contributions and funding for the cost of such construction shall be paid by the CITY as such costs accrue and within 30 days after a bill for same has been sent by the COUNTY to the CITY. Both the COUNTY and the CITY agree to pay to the other such funds as are indicated in the final audit set forth in Paragraph 2 (C) above, which will balance accounts between the parties. This Agreement shall be executed in triplicate and the COUNTY shall retain two (2) and the CITY shall retain one (I) copy. All shall be considered an original. City Manager Utilities Dire Tradewind Estates Subdivision - Approval ~o provide water and sewer services HISTORY Tradewind Estates is an existing subdivision located on the east side of South Federal Highway, in an unincorporated area. The Palm Beach County Engineering Dept. has designed water, sewer, paving and drainage improvements for the area, and zs seeking the City's approval to serve the area with water and sewer. Also along Federal Highway, adjacent co Tra~ewind Estates, is a strip of commercial buildings. These buildings, like the houses within Tradewind Estates, are currently on well and septic tank. Description Customarily, the City requires a landowner outside of the City Limits co execute a water service agreement with the City before we approve the plans and state applications for water and sewer main extensions. This approach is rather simple and straightforward when dealing with a single landowner. In this instance, however, there are over 60 different landowners within the Tradewinds Estates subdivision, plus several more mn the commercial strip along Federal Highway. A plat map indicating the affected properties ms attached for your reference. The County needs our approval before they can construct the water and sewer systems. The City needs an executed water servzce agreement from each individual landowner before we can provide service to their bullrings. In the pas~, we have brought each individual agreement back no the Commission for approval, as the landowners made application. This proved to be a very time-consuming task for the staff, the Commission. and the landowner, and necessitated a 2-4 week delay in the connection process.
