AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORDA,
AMENDING CHAPTER 2 ADMINISTRATION,
ARTICLE IW. SECTION 2-56 AND 2-56.1,
INCREASING BID THRESHOLDS; PROVDNG
EXCLUSIVE AUTHORITY TO THE CITY
MANAGER TO EXECUTE PURCHASE ORDERS
UNDEP~ THE BD THRESHOLD AMOUNTS, AND
REDEFINING WHEN COMMISSION ACTION IS
REQUIKED; PROVIDING FOR CONrFLICTS,
SEV~RABILITY, CODIFICATION AND AN
EFFECTIVE DATE.
WItEREAS, upon the recommendation of staff, the City Co~urmssion deems it to be
in the best interest of the citizens and residents of the City to amend Chapter 2. Section 2-56
and 2-56.1, by increasmg the bid threshold amounts for personal property, commodities and
services to $25,000 and for construction projects to $75,000, providing exclusive authority re
the City Manager to ex.ecme purchase orders below the threshold amounts, and redefine
when Commission action is required;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, THAT:
Section 1. Chapter 2. "Administration" is hereby amended by adding the words and
figures in underlined type, and by deleting the words and figures in struck-through type, as
follows:
Sec. 2-56. Purchasing agent, selection, duties; competitive bidding
The city commission shall appoint an officer or employee of the city, other than a
member of the city commission, as purchasing agent for the city who shall be
responsible for the purchase.--s~orage~--mqd d-issefibut4o~ of all supplies, materials,
equipment and other articles used by an ef£5~=¢5-, depa~men~u' agcn%' of the municipal
government. All purchases or sales of city property shall be subject to the approval of
the city commission and shall conform to such regulations as the city commission
may from time to time prescribed. Except as provided in section 2-56.1 all purchases

On the purchase of personal property if the city manager shall maintain that an
emergency exists tn regard to the purchase of any commodity so that the delay
incident to giving opportm~ty for competitive bidding would be detrimental to
the interest of the city, then the city manager shall file ~ith tl~ aiD~ clerk-a
statement m,~er oafl~-certifying the conditions and circumstances. Tk~e written

On any purchase of personal property where the funds for the price of the
entire purchase are being supplied by another governmental agency and no
funds of the city are being used towards the purchase price, the city ma~,ager

requirements of the governmental agency which is supplying the funds for the

(f) The purchasing agent may award a contract by accessing purchasing items
fi.om the Federal General Services Administration Contract, the State of

other purchasing contracts of any departments or subdivisions of the State of
Florida; or "piggy-back" of other govermment or national alliance bids

Section 2. Each and every other provision of Chapter 2 of the Code of Ordinances of the
City of Boynton Beach not herein specifically amended shall remain in full force and effect
as previously enacted.
Section 3. All ordinances or parts of ordinances in conflict herewith be and the same are
hereby repealed.
Section 4. Should any section or prowsion of this ordinance or portion hereof, any
paragraph, sentence or word be declared by a court of competent jurisdiction to be invahd.
such decision shall not affect the remainder of this ordinance.
Section 6. Authority is hereby granted to codify said ordinance.
Section 7. This ordinance shall become effective immediately upon passage.
