O72-31ORDINANCE NO. $2 - 31 AN ORDINANCE OF THE CITY OF BOYN~ON BEACH, FLORIDA, PR:OVIDING CERTAIN ADMINISTRATIVE POLICIES CONTROLLING THE PARKING OF VEHICLES AT~ THE SAID ¢)ITY~S MUNICIPAL BEACH LOCATED WITHIN THE TERRITORIAL LIMITS OF THE TOWN OF OCEAN R~)~E, FLORIDA; PROVIDING FURTHER FOR AUTHORIT~Z TO CODIFY; REPEALING PROVISIONS; SA~VI!~GS CLA~ffSE;, AN EFFEC~VE DATEi ~Vff ~ HOE OTI-IER PUt~P©SES. PREAMBLE WHEREAS, the City Council of the City of Boynton Beach, Florida, deems it essential that certain administrative policies be eslablishe with regard to parking of vehicles, as well as general utilization of its municipal beach property located within the territorial limits of the Town of Ocean Ridge, Florida; and WHEREAS, the City Manager has heretofore prepared a Policy Manual settbag forth necessary required regulations, copy of which is attached hereto; NOW, THEREFORE BE IT ORDAIN]ED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: That the Policy Manual setting forth certain ad- ministrative rules and regulations regarding utilization of the City of Boynton Beach, Florida, municipal beach property located within the Town of Ocean Ridge, Florida, a copy of which is attached hereto and hereby mad~ a part hereof, is hereby ratified, ad~pted and approved, and the City Manage: is hereby directed to implement subject procedures at the earliest possible date. That the responsibility for the administrative issuance and control of parking permits is hereby vested in the City Clerk of the City of Boyntcn ]Beach, Florida. Section 2: Authority to Codify: Specific authority is hereby granted to codify and incorporate this Ordinance in the City's existing Code. Section 3: Repealing Provisions: All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4: Separability: Each of the provisions of this Ordinance are separable, including word, clause, phrase or sentence, and if any portion hereof shall be declared invalid, the remaining portion shall not be affected but shall remain in full force and effect. Section 5: Penalty' Provisions: Any person, firm or corporation convicted of violating the provisions of this Ordinance shall upon conviction be pauish~d by fine not exceeding $500.00 or imprisonment in the Municipal jail for a period not exceedinE ninety (90) days~ b~ by both such fine and imprisonment. Section 6: Effective Date: This Ordinance shall become effective in the manner and at the time provided in the Charter and Ordinances of the City of Boymon Beach, Florida. Proof of employment shall be established througk the Personnel Department of the City. Persons who te~nate their employment with the City and '~ho are not City residents shall be required to scrape off their stickers and return remains to issuing office, ~. Have applicant complete permanent application~form. 3. Request proof o£ residency~. Proof established in accordance with Policy- #1. &. Req~separate vehicle registration for each parking pe~t to be issued. 5. Residents leasing automobiles should provide contract docu~nents establishing the lease agreement or arrangement. 65 IssuLug authority shall complete pa~kiug per~_~t application by separate permit numbers opposite the m~ke, model, aud year of each vehicle. 7. The purpose of temporar~permits will be to meet the requirements of the "resident" definition as it perta~s to paying guests at hotels and motels, and ghosts residing with residents for short periods of time. Temporary perm.~t~v~ll not he issued for a period exceeding, 90 .days. Class 1. Automobiles, motorscooters, )!otor bikes, motorcycles ................... Tax .08 $2.00 Class Buses, trucks and other motor v. ehicles not included or described in class lhereof Tax ?;39 $1o.oo Class 1. A passenger vehicle designed for family pleasure. Class 2. A passenger vehicle designed for group (more than 10 passengers) transportation other than family pleasure. Exceptions: 1. Vehicle having affixed thereto a Parking Permit issued in accordance with the rules and regulations of Policies 1 aud 2. 2. Official State, County, and City Vehicles entering the park in the per- formance of governmental functions. 3. The vehicles of Public Utility Companies, workmen, trade~nen, or sales- men when engaged in official park business.
