O72-30ORDINANCE NO. 72 ~ ~0 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING SECTION 13-39 OF THE CODIFIED ORDINANCE~OF SAID CITY, PROVIDING FOR INCREASED MONTHLY GARBAGE, TRASH AI~D REFU~ RATES; PROVIDING FURTHER FOR AUTHORITY TO CODIFY; SAVINGS CLAUSE; REPEALING PROVISIONS;, AN EFFECTIVE DATE; AND FOR OTI-IER PURPOSES. BE IT ORI)AINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: That Section 13,39 of the Codified Ordinances of the City of Boynton Beach, Florida, be, and the same, is hereby amended to read: Section 13-39 -- Containerized refuse service; charges and (1) Containerized refuse service. Containerized refuse service shall be inaugurated by the City at_any commercial or residential establishment where practical or in the promotion of improved sanitary conditions or elimination of health hazard. Containers are an~ shall remair~'J property of the City. The user is responsible for the protection of containers placed on or adja- cent to his premises. The user shall be held liable to the extent of the cost of repairs or replacement of containers when damage~ by fire, negligence, vandalism or other forms of abuse. (2) Free access to containers at all times shall be provided by user. All containers shall be located so that driver can dump container without leaving vehicle. Customers using garbage chutes shall pr, ovide additional containers for storage. T. ke (3) The size or number of containers shall be determined by the volume of refuse to be deposited and in direct relationship to the manner in which user elects to utilize the space provided in said container or containers, as charges shall be assessed on the basis of cubic yards of refuse removed from premises whether manually compacted or loose. A carton 3' x 3' x 3', not crushed shall be considered one cubic yard (1 cu. yd. ). (A) Commereial-Containerized Excluding Family Units. (a) Single user, $1. 25 per cubic yard. Charges to be based on container size and frequency of collection (b) Removal charges for mechanically compressed refuse shall be computed at 3 to 1o (Containers furnished by owner. ). Two or more places of business using a single con- (c) tainer shall be assessed charges in the amount of $1, 25 per cubic ya.rd, and shall be charged on pro- rated basis according to level c~ service. Any joint user generating one cubic yard or less per month, sha~l be charged minimum fee of $5.00 monthly. (B) Non-containerized Commerical (a) Refuse picked up from bins shall be charged at a rate of $3.75 per cubic yard, (noncompacted measure). Small businesses, generating one cubic yard per mont] or less, $5.00 per month. (b) Refuse picked up from residential type cans shall be charged atthe rate of 8.1¢ per can or 2.6¢ per cubic yard. Level of service shall be negotiated by the refuse colleciion service department. Minimum of $5.00 per month shall be charged for 1 can or 3 cubic feet picked' up 2 times per week, and additiom ] charge of 629 per month shall be made for each pickup in excess thereof. (C) Residential rates (a) $2.50 per month for single family dwelling. (b) $2. 50 per month for each family unit duplex or triplex. (c) $2. 50 per month for each family unit for apartments and condominiums. (d) $2. 25 per month for each family unit rot apartments and condominium thai can be served by high volume containers (Containerized). (e) Trailer parks - $2.50 per month per ~tra~le,r. (f) Special pickup charges - $18.75 minimum charge for curbside pickup of horti~cultural refuse not exceeding 8 cubic yards, $36. 00 for amounts from 8 To 16 cubic yards. (D) Responsibility of occupanT. (a) Furniture, appliances, toys, bicyhles, cans, automo- tive waste, crates, etc. shall not be place~,~ streez rights-of-way, but shall be disposed of by occupant. Residents of the City shall not be charged for disposal of said items at the City Dump. (b) All persons delivering garbage, trash, refuse and debris to the City Dump shall be charged at the rate of 50Q per cubic yard, with a nimirmm charge of $1.00 for each dumping, except as provided for in this Article. Persons using the City Dump as set out in this section shall do so only after purchasing tickets for said pLr pose from the City. -2- Section 2: Authority to Codify: Specific authority is hereby granted lo codify and iaterporale ibis Ordinance in lhe City's existing Code. Section 3: Separabilily: Each of lhe provisions of this Ordinance are separable, including word, clause, phrase or sentence, and if any portion thereof shall be declared invalid, the remaining portion shall not be affected but shall retrain in full force and effect. Section 4: Repealing Provisions: All ordinances or paris of ordinances in conflict herewith are hereby repealed. Section 5: An effective Date: This Ordinance shall become effective in lhe manner and au the time provided in the Charier and Ordinances of the City of Boyn~on Beach, Florida.
