THE SAID CITY, TO WIT: THAT PORTION OF N,. E. 7TH
STREET LYING WI~ST OP LOTS 11 TI{ROUGH 22, BLOCK 7,
LAKE ADDITION, CONSISTING OF APPROXIMATELY 600 LINEAL
PEET, RECITING BY WHAT METHOD SAID SPECIAL ASSESSMENT
IS MYJDE AND THE TIME W-HEN SBIME SHALL BECOME PAYABLE,
PROVIDING FOR TNE METHOD OF COLLECTION THENEOP~ AND
FOt~ OTHER PURPOSES
WHEREAS= pursuant to the provisions of Section 160 of the
Charter of the CITY OF BOYNTON BEACH, FLORIDA, the City has heretofore
caused a certain public street to be constructed over the property more
particularly described as: That portion of N. E. 7th Street lying West
of Lots 11 through 22, Block 7, Lake Addition, consisting of approxi-
mately 600 lineal feet; Eluding drainage; and
WHEREAS, the City Clerk has heretofore compiled an assessment
roll Showing the lots and land assessed to pay the cost thereof in con-
nection with subject improvemen~ and the amount of assessment as t¢
each such lot or land, which said roll has heretofore been approved by
the City Council; and
WHEREAS~ proper legal notice of the approval of said roll has
been given and a public hearing held relative thereto, at which time
no objections were made, or if objections were made, same were deemed
insufficient by the City Council;
NOW, THEtLEPORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA:
Section 1: That the special assessment roll covering the
above-described project, a true copy of which is attached hereto and
hereby made a part hereof, is hereby ratified, approved and confirmed,
and the amounts indicated for each lot or oarcel described therein are
hereby levied against same as a special improvement and same shall
constitute liens against said land as of the effective date of this
Ordinance, each of said parcels along subject improvement having been
assessed on a front footage basis~ charging each parcel its propor-
tionate share by dividing its respective front footage into the total
improvement cost.
Section 2: Each property owner shall have the privilege of
paying the entire assessment as to his property.within ninety (90) days
from the attachment of said impmovement lien without penalty. If any
owner fails to pay said lien within said ninety (90) day period~ it
shall be paid in three consecutive equal installments, payable as other
ad valorem taxes are paid, ~ommencing with year 1973, together with
interest ar the rate of 8% per annum from the date of attachment of said
lien on the unpaid balance thereof.
Section 3: Each of the provisions of this Ordinance are
separable, including word, clause, phrase, or sentence~ and if any
portion hereof shall be declared invalid, the remaining portion shall
not be affected, but shall remain in full force and effect.
Section 4: Repealing Provisions: All ordinances or parts
of ordinances in conflict herewith are hereby repealed.
Section 5: Effective Dare: This Ordinance shall become
effective in the manner and at the time provided in the Charter and
Ordinances of the City of Boynton Beach~ Florida.
