AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, EXTENDING THE TERRITORIAL LIMITS OF
SAID MUNICIPALITY BY THE ANNEi~ATION OF A CERTAIN
UNINCORPORATED TRACT OF LAND CONTAINING L~$S
THAN TEN REGISTERED VOTERS, LYING CONTIGUOUS THERE-
TO AND WITHIN THE SAME COUNTY, TO-WIT: TRACT OF

~F~I~;'- REDEFINING THE MUNICIPAL BOUNDARIES, REPEAL-
ALL~O~DINANCES (~R~PARTS OF ORDINANCES IN C~ELICT
HEREWITH; PROVIDING FOR AUTHORITY TO CODIFY, AN
EFFECTIVE DAT~, ZONING CLASSIFICATIONS, AND FOR
OTHER PUI~ ~DSES.
WHEREAS, the owner of the prpperty more parlicularly
described hereinafter has heretofore petitioned the City Council of the City
of Boynton Beach, Florida, requesting the am~exaiion of certain property
lying adjacent and contiguous to the territorial limits of said municipality
and within the same County, to ~ae municipal territorial limits of said
City; and
WHEREAS, all requirements of the laws of the State of Florida,
relative annexation of contiguous territory have been complied with; and
WHEREAS, the City Council of the City of Boynton Beach,
Florida, deems the annexation of subject ~ract to be beneficial to the
municipality and to the owner of said tract;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1: That the City of Boynton Beach, Florida, hereby
annexes to the territorial limits of the City of Boynzon Beach, Florida,
the following described parcel:
A parcel of land in Lot 11, BENSON BROS. SUBDIVISION,
Palm Beach County, Florida, according to the Plat thereof
recorded in Plat Book 5, Page 27, Public Records of Palm
Beach County, Florida, said parcel being more particularly
described as fo[[ow~ ALL that par~ of said Lot ll lying
Westerly of the Westerly right-of-way of State Road
A-1-A and Easterly- of the Easterly r~ght-i~-way line of
the IniracoastaI Waterway, LESS THE following described
parcel: BOUNDED on the North by a line parallel ~o
and 15 feet Southerly from, measured at right angles to,
the North Line of said Lot 11, BENSON BROS. SUBDIVISION:
BOUNDED ON THE East by the Westerly right-of-way line of

SECT~N 2: Thai subject property upon annexation shall be
zoned "Zone R-3 and Zone C-I" pursuant to the Master Zoning Code of the
City of Boynton Beach, Florida, as more particularly set forth on site plan
development map of said area now on file in the office of the City Manager
of ~he City of Boynton Beach, Florida, which site plan development map is
hereby adopted by reference and hereby made a part hereof.
SECTION 3: All ordinances or paris of ordinances in conflict
herewith are hereby repealed.
SECTION 4: Should any section or provision of this Ordinance~
or any portion hereof, be declared by a court of competent jurisdiction to be
invalid, such decision shall nol affect the validity of the remainder hereof
as a whole or any part hereof, other than the part declared to be invalid.
SECTION 5: This Ordinance shall become effective in [he
manner and at the time provided by the Charter and'Ordinances of the City of
Boynion Beach, Florida.
