AN EMERGENCY ORDINANCE OF THE C~ TY OF
BOYNTON BEACH, FLORIDA, PROVIDING FOR THE
CREATION OF THE OFFICE OF MUNICIPAL PUBLIC
DEFENDER SETTING FORTH THE TERMS AND DUTIES
OF SAID POSITION AND ESTABLISHING COMPENSATION
THEREFOR; PROVI]gING FURTHER FOR AUTHORITY TO
CODIFY, REPEALING PROVISIONS, SA~NGS CLAUSE,
AN EFFECTIVE DATE AND FOR OTHER PURPOSES.
PREAMBLE
This Ordinance is deemed lo be an emergency measure enacted
for the [mmediale preservation of the public peace, property, health and
safely and for the efficient daily operation of the Municipal court system.
Seclion 1: There is hereby created the non-classified office
of Municipal Public Defender to be filled by appointment by lhe City
Council with said officer to serve at the pleasure of the City Council. The
dulies of said office shall consist of undertaking the defense of any accused
persons appearing before the Municipal Courl who are deemed by the
presiding Judge or Judge Ad Litem of the Municipal Court when said Judge
or Judge Ad Litem shall determine said accused is indigent and is accused
of an offense thai there is a possibility of a jail term. The compensation
for the office of Municipal Public Defender shall be $ [0~,¢~ ~£¢: .~.
Section 2: Authorily ~o Codify: Specific authority is hereby
granted to codify and incorporate this Ordinance in the City's existing Code.
Seclion 3: Repealing Provisions: All ordinances or paris of
ordthanc ss in conflict herewith are hereby repealed.
Section 4: Separability: Each of the provisions of this Ordinanc
are separable, including word, clause, phrase or sentence, and if any
portion hereof shall be declared invalid, the remaining portion shall not
be affecled, bul shall remain in full force and effect.
Section 5: This Ordinance is deemed to be an emergency measure
and shall take effect immediately.
