AN ORDINANCE OF THE CITY OF t~OYNTON BEACH,
FLORIDA, EXTENDING THE TERRITORIAL LIMITS OF
-SAID MUNICIPALITY BY THE ANNEXATION OF A
CERTAIN UNINCORPORATED TRACT OF LAND CONTAINING
LESS THAN TEN REGISTERED VOTERSj LYING CONTIGUOUS
THERETO AND WITHIN TIlE SAME COUNTY, TO-WIT:
A PARCEL OF LAND LOCATEt~ IN SECTION 9, TOWNSHIP
45 SOUTH, RANGE 43 EAST, PALM BEACH COUNTY. IVIORE
PARTICULARLY DE SCRIBED HEREINAFTER; REDEFINING
THE MUNICIPAL BOUNDARIES, REPEALING ALL ORDINANCES
OR. PARTS OF ORDINANCES IN CONFLICT ITEREWITH;
pROVIDING FOR AUTHoRITy TO CODIFY, AN EFFECTIVE
DATEj ZONING CLASSIFICATIONS. AND. FOR OTItER
PURPOSES.
WHEREAS, the owner of the property more particularly
described hereinafter has heretofore petitioned the City Council of the City
of Bosrnton Beach, Florida, requesting the annexation of certain property
lying adjacent and contiguous to the territorial limits of said municipality
and within the same Coumy~
and
the municipal territorial limits of said City;
WHEREAS, said tract of land contains less than ten registered
voters, and
WHiEREAS, all requirements of the Charier of'the City of
Boyn.ion Beach, Florida~ and the laws of the State of Floridaj relative
annexation of contiguous territory have been complied with; and
WHEREAS, the City Council of the City of Boyn~on Beach,
Florida, deems the annexation of subject~ract to be beneficial to the
municipality and to the owner of said tract,
NOW. THEREFORE. BE [T ORDAINED BY THE CITer COUNCIL
OF THE CITY OF BOYNTON BEACH~ FLORIDA:
Section 1: That the City of Boynton Beach, Florida, hereby
annexes to the territorial limits of the City of Boynion Beach. Florida. the
following described parcel:
A parcel of land l~dng in Seclion 9, Township 45 South,
Range 43 East, Palm Beach County, Florida; said parcel
being more particularly described as follows: The South
52.20 feet of Tract i; all of Tract 2 and Tract 3. less the
East 435, 60 feet of the South 300.0 feet of said Tract 3,
as recorded on the plat of PaLm Beach Memorial Park,
Plat ~i, as recorded in Plat Book 25, Page 226, Public
Records oY Palm Beach County, 'Florida, said parcel
c~niai~iing 21.53 acres; more or less.
Section 2 That subject properly is hereby zoned Zone
pursuant to the Master Zoning Code of the City of Boynton Beach, Florida.
Section 3: The territorial boundaries of the City of Boynton
Beach~ Florida, are hereby redefined so as to include the above-described
property.
Section 4: Separability: Each of the provisions of this
Ordinance are separable and if any section, subsection, clause, phrase or
portion of this Ordinance is for any reason held invalid by any Court of
competent jurisdiction, the remaining portions shall not be affected but shall
remain in full force and effect.
Section 5: Authority To Codify: Specific authority is hereby
granted to codify and incorporate this Ordinance to the City's existing Code.
Section 6: Repealing Provisions: All ordinances or parts of
Ordinances of the City of Boynzon Beach, Florida, in conflict herewith are
hereby repealed.
Section 7: Effective Date: This Ordinance shall become effective
in the manner and at the time provided by the Charter and Ordinances of the
City of Boynton Beach, Florida.
