O72-16ORDINANCE NO. 72 - |~ AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, EXTENDING THE TERRITORIAL LIMITS OF SAID MUNICIPALITY BY THE ANNEXATION OF A CERTAIN UNINCORPORATED TRACT OF LAND CONTAINING LESS THAN TEN REGISTERED VOTERS, LYING CONTIGUOUS AND WITHIN THE SAME COUNTY; TO-WIT: .OF LAND LOCATED IN SECTION 4, TOWNSHIP 46 RANGE 4.3 EAST, PALM BEACH COUNTY, MORE PARTICULARLY DESCRIBED OH PARTS OF ORDINANCES OR AUTHORITY TO ~YNYNG CLASSIFICATIONS. WHEREAS, the~ov~n~r of tl~e property more parlicularly described hereinafter has heretofore pe~:.~ti~ed the City Council of the City of Boynton Beach, Elomida, requesting tt~ anne~l~on of certain property lying adjacent and contiguous to the territorial limits of said ~i~nicit~ality and within the same Couniy~ to the municipal territorial limits of said City; and WHEREAS, said tract of land contains less than ten registered voters ~ aIld WHEREAS, all requirements of the Charter of the City of Hoynton Beach, Florida. and the laws of the Sta!e of Florida~ relative annexation of contiguous territory have been complied with; and WHEREAS, the City Council of the City of Boynton Beach, Florida, deems the annexation of subject tract to be beneficial to the municipality and to the owner of said tract. NOW, THEREFORE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: That the City of Boynton Beach, Florida, hereby annexes to the territorial limits of the City of Boynton Beach, Florida, the following described parcel: That part of the South 1/2 of the Southwest 1/4 of the Northeast 1/4 of Section 4, Township 46 South, Range 43 East, Palm Beach County, lying North of right-of-way described in Official Record Book 944, Page 117 (Gulfstream Boulevard) and~ lying V~est of right-of-way described in Offiai~l Record ]~o~k 160~ Page 581 (State Road No. 5), and l~ng East of East right-of-way of Old Dixie H~way, together wit~ ~ .portions of richt-of-way of U. S . Highway 1, Gu~stre~ BoUlevard, ~ld Dixie ~hway and.~ E. C ~i~ht- of-way lying adjacent to ~e above described tracl. Section 2: Thaz subject property is hereby zoned Zone C-1 pursuanz to lhe ~laster ~oning C,ode of the City of Boynton Beach, Florida. ~.ection 3: The territorial boundaries of the City of Boyn~on Beach, Florida, are hereby redefined so as to include the above-described property. Section 4: Separability. Each of the provisions of this Ordinance are separable and if any section, subsection, clause, phrase, or portion of this Ordinance is for any reason held invalid by any Court of competent jurisdiction, the remaining portions shall not be affected but shall remain in full force and effect. Section 5: Au~rity to Codify: Specific authority is hereby granted to codify and incorporate this Ordinance to the City's existing Code. Section 6: Repealing Provisions: All ordinances or parts of Ordinances of the City of Boynton Beach, Florida, in conflict herewith are hereby repealed. Section 7: Effective Date; This Ordinance shall become effective in the rnamaer and at the time provided by the Charter and Ordinance of the City of Boynzon Beach, Florida.
