O72-11ORDINANCE NO. 72 - 11 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA. DECLARING THE INTENTION OF SAID CITY TO EXTEND ITS MUNICIPAL TERRITORIAL LIMITS BY THE AlkrNEXATION OF AN UNINCORPORATED TRACT OF LAND LYING CONTIGUOUS TH]ERETO AND WITHIN PALM BEACH COUNTY, FLORIDA, TO-WIT: A PARCEL C~ LAND LOCATED IN SECTION 4, TOWNSHIP 46 SOUTH, RANGE 43 EAST; PALM BEACH COU. NTY, FLORIDA, BEING'.MOI~. PARTICULARLY DESCRIBED HEREINAFTER; PROVIDING FOR REPEALING AND SAVINGS CLAUSE, EFFECTIVE DATE, AND. OTHER PURPOSES WHEREAS, the owner of a certain tract of land more particularly described hereinafter, lying a~ijacent and contiguous to the territorial limits of the City of Boynton Beach, and within Palm Beach County, Florida, has petitioned the City Council for the annexation of said property by the Ciby of Boyn~on Beach; and WHEREAS, it is considered to be for. the best interest of the City of Boynton Beach, Florida, and for the owner of subject~act that same be annexed and included within the municipal territorial limits of the City; NOW, THEREFORE, be it ordained by the City Council of the City of Boymon Beach, Florida: SECTION 1: That the City Council of the CITY OF BOYNTON BEACH, FLORIDA, hereby declares its intention To annex the following described tract of land to the munieipal territorial limits of the City of Boynton Beach, Florida: That part of the South 1/2 of the Southwest 1/4 of the Northeast 1/4 of Section 4, Township 46 South, Range 43 East, Palm Beach County, lying North of right-of-way described in Official Record Book 944, Page 117 (GuLfstream Boulevard) and lying West of right-of-way described in Official Record Book 160, Page 581 (State Road No. 5), and lying East of East right-of-way of Old Dixie Highway, together with those portions of right-of-way of U. S. Highway 1, Gulfstream Boule- vard, Old Dixie Highway and F. E. C. right-of-way lying adja- cent tb the above described tract. SECTION 2: That subject property upon amaexation shall be zoned "Zone C-l", pursuant to the master zoning code of the CITY OF BOYNTON BEACH, FLORIDA. That the City Clerk is hereby directed to proceed with publication of nolice of adoption of this Ordinance in accordance with the provisions of Section 7(32) of the Charter of the City of Boynzon Beach, Florida. SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4: Should any section or provision of this ordinance, or any portion hereof: be declared by a courz of competent jurisdiction to be invalid, such decision shall not affecz the validity of the remainder hereof as a whole or any part hereof° other than the part declared to be invalid. SECTION 5: This ordinance shall become effective in the manner and at the time provided by the Charter and Ordinances of lhe City of Boynion Beach, Florida.
