AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING THE PROVISIONS OF SE'cT;~o~
2~24 OF THE CODIFIED ORDINANCES OF THE CITY
OF BOYNTON BEACH, FLORIDA, PROVIDING FOR
REMOVAL OF CITY MANAGER; PROVIDING FURTHER
FOR SAVINGS CLAUSE, REPEALING PROVISIONS,
AUTHOItITY TO CODIFY, AN EFFECTIVE DATE, AND
FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON
BEACH, FLORIDA:
Section 1: That Section 2-24 of the codified ordinanees of the
City of Boynton Beack, Florida, be, and the same is hereby amended as
follows: The City Council may remove the manager from office in
aecordance with the following procedures:
(a) The council shall adopz by affir~native vote of a majority of
all its members a preliminary resolution which must state
lhe reasons for removal and may suspend the manager from
duty for a period of not to exceed forty-five (45) days, A
copy of the resolution shall be delivered promptly to the
manager.
(b) Within five (5) days after a copy of the resolution is delivered
to the manager, he may file with the council a written request
for a public hearing. This hearing shall be held at a council
meeting not earlier than fifteen (15) days nor later than thirty
(30) days after ihe request is filed. The manager may file
with the council a written reply not later than five (5) days
before the hearing.
(c) The council may adopt a final resolution of removal, which
may be made effectiYe immediately, by affirmative vote of a
majority of all its members at anytime after five (5) days
from the date when a copy of the preliminary resolution was
delivered to the manager, ~ he has not requested a public
hearing, or at any time after the public hearing if he has
requested one. The m'anager shall continue to receive his
salary until the effectiv~ date of a final resolution of removal.
The .aetion of the c.ounc'il~in suspending or removing the
manager shall not be subject to review by any court o~kagency.
Section 2: Authority to CodLfy: Specific authority is hereby
granted to codify and incorporate ~his Ordinance in.ibc City's exisiing code.
Section 3: Repealing Provisions: All ordinances or parts of
ordinances in cor~f~ict herewith are hereby repealed.
Section 4: Separability: In the event any section or provision
of this or any portion hereof be declared invalid, the remaining portion
shall not be affected, bui shall remain in full force and effect.
Section 5: Effective Date: This Ordinance shall become effectiv
in the manner and at the time provided in the Charter and Ordinances of the
City of Boynton Beach° Florida.
