R20-141 1 RESOLUTION R20-141 2 3 A RESOLUTION OF THE CITY OF BOYNTON BEACH, 4 FLORIDA, APPROVING THE CERTIFICATE REGARDING 5 SUBSTANTIAL COMPLETION AND FINAL ACCEPTANCE 6 FOR THE POLICE STATION PROJECT AND THE NOTICE OF 7 COMPLETION FOR THE POLICE STATION PROJECT 8 CONSTRUCTED AS PART OF THE TOWN SQUARE PROJECT 9 AND AUTHORIZING THE MAYOR TO SIGN THE NOTICE OF 10 COMPLETION AND RELATED DOCUMENTS WITH RESPECT 11 TO THE POLICE STATION PROJECT; AND PROVIDING AN 12 EFFECTIVE DATE. 13 14 WHEREAS, the agreement with CFP Boynton Beach Town Square, LLC for the 15 Police Station construction requires the City to approve a Certificate Regarding Substantial 16 Completion and Final Acceptance Notice of Final Completion to finalize the construction 17 of the project; and 18 WHEREAS, all of the buildings have received the final Certificate of Occupancy 19 and Final Approval by staff and are fully operational. 20 NOW,THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF 21 THE CITY OF BOYNTON BEACH, FLORIDA,THAT: 22 Section 1. The foregoing"Whereas" clauses are hereby ratified and confirmed as 23 being true and correct and are hereby made a specific part of this Resolution upon adoption 24 hereof. 25 Section 2. The City Commission of the City of Boynton Beach, Florida does 26 hereby approve the Certificate Regarding Substantial Completion and Final Acceptance for 27 the Police Station project and the Notice of Completion for the Police Station project 28 constructed as part of the Town Square Project and authorize the Mayor to sign the Notice of 29 Completion and related documents with respect to the Police Station project. In addition to the foregoing, Section 1.24 and Section 9.13 of the Police Station Lease contain certain provisions regarding the Final Acceptance of the Police Station Project and Section 12.4 of the Police Station Development Agreement provides certain events that CFP and the City must agree shall have occurred in order to establish the Final Acceptance of the Police Station Project. In connection with the foregoing, CFP hereby certifies and represent as follows: vi. In accordance with Section 1.24(a) of the Police Station Lease and Section 12.4(a) of the Police Station Development Agreement, the City has issued all certificates of occupancy for the Police Station Project. vii. In accordance with Section 1.24(b) of the Police Station Lease and Section 12.4(b) of the Police Station Development Agreement, each Contractor has issued its "Certificate of Substantial Completion", together with its"Affidavit of Payment of Debts and Claims", together with final waivers and releases of liens. viii.
