R20-139 1 RESOLUTION R20-139 2 3 A RESOLUTION OF THE CITY OF BOYNTON BEACH, 4 FLORIDA, APPROVING THE CERTIFICATE REGARDING 5 SUBSTANTIAL COMPLETION AND FINAL ACCEPTANCE 6 FOR THE FIRE STATION#1 CONSTRUCTED AS PART OF THE 7 TOWN SQUARE PROJECT AND AUTHORIZING THE MAYOR 8 TO SIGN THE CERTIFICATE REGARDING SUBSTANTIAL 9 COMPLETION AND FINAL ACCEPTANCE AND RELATED 10 DOCUMENTS WITH RESPECT TO THE FIRE STATION #1; 11 AND PROVIDING AN EFFECTIVE DATE. 12 13 WHEREAS, the agreement with CFP Boynton Beach Town Square, LLC for the 14 Fire Station#1 construction requires the City to approve a Certificate Regarding Substantial 15 Completion and Final Acceptance Notice of Final Completion to finalize the construction 16 of the project; and 17 WHEREAS, all of the buildings have received the final Certificate of Occupancy 18 and Final Approval by staff and are fully operational. 19 NOW,THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF 20 THE CITY OF BOYNTON BEACH,FLORIDA,THAT: 21 Section 1. The foregoing"Whereas" clauses are hereby ratified and confirmed as 22 being true and correct and are hereby made a specific part of this Resolution upon adoption 23 hereof. 24 Section 2. CFP has caused a Notice of Completion with respect to the Fire Station Project to be recorded. In addition to the foregoing, Section 1.24 and Section 9.13 of the Fire Station Lease contain certain provisions regarding the Final Acceptance of the Fire Station Project and Section 12.4 of the Fire Station Development Agreement provides certain events that CFP and the City must agree shall have occurred in order to establish the Final Acceptance of the Fire Station Project. In connection with the foregoing, CFP hereby certifies and represent as follows: vi. In accordance with Section 1.24(a) of the Fire Station Lease and Section 12.4(a)of the Fire Station Development Agreement, the City has issued all certificates of occupancy for the Fire Station Project. vii.
