Section 2: Separability: Each of the provisions of this Ordinance are separable, ineluding word, clause, phrase, or sentence, and if any portion hereof shall be declared invalid, the remaining portion shall not be a,ffected, but shall remain in full force and effect. Section 3: Repealing Provisions: All ordinances or parts of ordinances m conflict herewith are hereby repealed. Section 4: Effective Date: This Ordinance shall become effective in the manner and at the time provided in the Charzer and Ordinances of the City of Boynton Beach, Florida. (b) Substantial change in permitted uses~ location of build- ings or other specifications of the development plans may be permitted following public hearing and approval by the City Council, upon receipt of the recommendations of the Pla~ing and Zoning Board. ~ Site Plan Approval The Plann~g and Zoning Board shall review and approve all site plans for all ~tructures constructed ~n the City excepting single ~amily~and duplex residential units. Approval of site ~lans shall not be g~nted nor shallany building permit be ~ssued unless and until: 1. The applicant files a request with the Building 0fficimk and a fee equal to $~0.00 for the first acre of land included in the site plan plus $10.00 for each addition- al acre. The Pla~ing and Zoning Board shall make findings that the. proposed plan~ with any appropriate conditions and safeguards that the Board may deem necessary, will not adversely affect the public interest~ In reaching its conclusion and in making the findings required in (1) above~ the Planning and Zoning Board shall consider and weigh, among others~ the following factors~d-.standards, where applicable~ and shall show in record such factors as were considered and the disposition made thereof. Further~ the Board shall find in the case of any of these factors afd standards where they may be relevant and applicable~ that the purposes and requirements for grhnting the site plan approval have been met by the applicant: Ingress and egress to the property and the pro- posed structures thereon~ if any including such considerations as automotive and pedestrian safet~ and convenience~ traffic flow and control~ and access in case of fire or c~tastrophe; (b) Off-street parking and loading areas~ where re- quired~ including consideration.of relevan~ factor, s in (a) preceding and the econommc~ noise~ glare or odor effects of the location of such areas on adjacent and nearby properties and properties generally in the district; (c) R~fus? and service areas, fnel~ding consideration or relevant factors in (al an~ (b) preceding; (d) U~ilities and drainage including such considera- tions as hook-in locations and availability and compatibility of utilities fo~ the proposed use of structure; (e) Screening and buffering, iacSuding consideration ~of such relevant factors as type, dimensions.and character to preserve and ~mprove compatibilmty and harmony of use and ~tr6c~ures between the proposeG special exception and the uses ahd structures of adjacent and nearby properties and properties generally in the district; (f) Signs, if any, and proposed exterior lightingS if any, with reference to glare, traffic safety an~ economic effects of same on properties i~'the district, and compatibility and harmony with othe~ properties in the district; (g) Yard and open spaces; (h) Height of structure where related to uses and structures on adjacent land nearby properties and properties generally in the district; (i) General compatibility and harmony of the use and structures wi-th the uses and structures on adjacent and nearby properties and properties generally in the district; (j) Economic effects on adjacent and nearby propertie~ and properties generally in bhe district of the grant of the special exceptionS (k) Landscape treatment of the site~ Violation of such conditions and safeguards~ when made a part of the terms under which the site plan was granted, shall be deemed a violation of the zonin~ ordinance and punishable under Section l0 (~) of the zoning ordinance° The placing of all mobile homes shall following requirements~ Home Subdivisions and Mobile Home Parks:
