AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING PROVISIONS OF SECTION 3-21(b)
OF THE. CODIFIED ORDINANCES OF SAID CITY, PER-
TAINING TO DISTANCE Rt~QUIREMENTS BETWEEN
LOCATIONS FOR SALE OF ALCOHOLIC BEVERAGES,
PROVIDING FURTHER FOR AUTHORITY TO CODIFY,
REPEALING PROVISIONS, A SAVINGS CLAUSE,
EFFECTIVE DATE AND 'FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTflXl
BEACH, FLORIDA:
Section 1: That Section 3-21{b) of the codified ordinances of the City
of Boynton Beach, Florida be, and the same is hereby amended, by adding
thereto lhe following:
Provided further that such distance requirements shall not prohibil
the issuance of a package szore license in shopping centers containing
a net ground building area of noz less than eight (8) acres,
including dedicated rights of ways under one ownership of title, with
an improved building area of noz less than 65,. 000 square feet of floor
area thereon, and with an improved and developed parking area for
not less than 350 vehicles. Only one such package store will be per-
mitred in each shopping center; and said package store shall be lo-
cated az least(500) five hundred feet from any church or school, with
said distance being measured as otherwise provided hereinabove.
Section 2: Se~arability: Each of the provisions of this Ordinance are
separable, including word, clause, phrase or sentence, and if any portion
hereof shall be declared invalid, the remaining portion shall not be affected
but shall remain in full force and effect.
Section 3: Authority to Codify: Specific authority is hereby granted
CODIFY AND INCORPORATE THIS Ordinance in the City's existing Code.
Section 4: Repealing Provisions: All ordinances or parts of ordinanc
in conflict herewith are hereby repealed.
Section 5: Effective Date: This Ordinance shall become effective in
the manner and az the time provided in the charter and ordinances of the City
of Boynton Beach, Florida.
