AN EMERGENCY ORDINANCE OF THE CITY OF
BOYNTON BEACH, FLORIDA, AMENDING PROVISIONS
OF ~ECTION 29-3 OF THE CODIFIED ORDINANCES OF
$~D CITY ESTABLISHING SPEED LIMIT OF TRAINS
THROUGH THE MUNICIPAL LIMITS OF SAID MUNICI-
PALITY; PROVIDING FURTHER FOR AUTHORITY TO
CODIFY, REPEALING PROVISIONS, SAVINGS CLAUSE~
PENALTY PRO~SIONS~ .AN EFFECTIV~ DATE AND
FOR OTHER PURPOSES.
PREAMBLE
This ordinance is deemed to be an emergency measure enacted for the
immediate preservation of the public peace, property, health and safety of the
inhabitants of the City of Boynton Beach, Florida, and for the efficient daily
operation of the municipal Police Department.
Section 1: The provisions of Section 29-3 of the Codified Ordinances of
the City of Boynton Beaeh be and the same are hereby amended to read:
See. 29-3° Railroads - Speed limiz of trains°
(a) Regulated. It shall be unlawful for any person, firm or corporation
to operate any train, either of passenger cars or freight cars, or both, drawn
by one or more locomotives, driven by diesel or steam power or otherwise,
or any other type of r~ilway vehicles, other than those set forth in Sec. 29-3.
of this Code of Ordinance, upon railway tracks within the corporate limits of
the City of Boynton Beach, Florida, at a speed in excess of 35 miles per hour,
(b) Penalty. Any person, firm or corporation convicted of violating the
provisions of this section shall be punished by a fine not exceeding $500. 00 or
by imprisonment for a period of not exceeding ninety days or both, such fine
and imprisonment.
Section 2: Separability: Each of the provisions of this Ordinance are
separable, including word, clause, phrase or sentence, and if any portion her~
of shall be declared invalid, the remaining portion shall not be affected but
shall remain in full force and effect.
Section 3: Authority to Codify: Specific authority is hereby granted %o
codify and incorporate this Ordinance in the City's existing Code.
Seclion 4: Repealing Provisions: Alt ordinances or parts of ordinances
in conflict herewith are hereby repealed.
Section 5: Effective Date: This Ordinance shall become effective in the
manner and at the time provided in the charier and ordinances of the City of
Boynton Beach, Florida.
