AN EMERGENCY ORDINANCE OF THE CITY OF
BOYNTON BEACH° FLORIDA~ AMENDING PRO-
VISIONS OF ORDINANCE 71-14 OF SAID CITY
PERTAINING TO EXTENSIONS~ REPLACEMENTS
OR ADDITIONS TO E~ISTING MUNICIPAL UTILITY
SYSTEMS; PROVIDING FURTHER FOR AUTHORITY
TO CODIFY. REPEALING PROVISIONS,. SAVINGS
CLAUSE~ !~ENALTY PROVISIONS. AN EFFECTIVE
DATE AND ]FOR OTHER PURPOSES.
PREAMBLE
This Ordinance is deemed to be an emergency measure enacted
for lhe purpose of providing for the immediate preservation of the public peac~
property, health and safety of the inhabitants of the City o£ Boyn~on Beach,
Florida~ and for the efficient daily operation of the Municipal Public Works
Department and utility systems of the City.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BOY~NTON BEACH, FLORIDA:
Section 1: Thai the second sentence of the first paragraph of
Seclion 1 of Ordinance No. 71-14 of the City of Boynton Beach, Florida.
enacted on May 18, 1971, providing for amendment to Section 15-A-1 of the
Codified Ordinances of said City is hereby amended to read~
"In addition, subsequent to the foregoing munieipal officials
approving such plans and specifications for proposed additions, replacements
or extensions to the municipal utility systems, same shall be approved by lhe
Florida State Board of Health prior to issuance of constructinn permits."
Furlher, ~hat sub-paragraph (c) of Section 1 of said Ordinance
No. 71-14 shall be amended to read:
"(c) The size, type, number and meihod of installation of any
water meter or meters proposed to be installed or added to the municipal
water utility system in connection with any building project as hereinabove
described, shall be determined and approved prior to installation thereof by
~he Municipal Public Works Director. In addition, all required water meters
servirLg the proposed development shall be placed at locations which will
municipal personnel to efficienlly service and read said meters and developer

shall grant permission and legal authority to the City for the purpose of City
personnel having access to said meters."
Section 2: Separability: Each of the provisions of this Ordinance
are separable, including word, clause, phrase or sentence, and if any portion
hereof shall be declared invalid, the remaining portion shall not be affected but
shall remain in full force and effect.
Section 3: Authority To Codify: Specific authority is hereby
granted to codify and incorporate this Ordinance in the City's existing Code.
Section 4: l{epeal~ng Provisions: All ordinances or parts of
ordinances in conflict herewith are hereby repealed.
Section 5: Penalty Provisions: Any person, firm or corporation
convicted of violating the terms of this Chapter shall, upon conviction, be fined
by a fine not exceeding $500. 00 or imprisonment in the City Jail for a period
not exceeding ninety (90) days: or by both such fine and imprisonment.
Section 6: Effective Date: This Ordinance shall become effective
in the manner and at the time provided in the charter and ordinances of the ,
of Boynton Beach, Florida.
