AN EMERGENCY ORDINANCE OF THE CITY OF BOYNTON
BEACH, FLOI~IDA, AMENDING PROVISIONS OF SECTION
29-3 OF THE CODIFIED ORDINANCES OF SAID CITY
ESTABLISHING SPEED LIMIT ~OF TRAINS THROUGH THE
MUNICIPAL LIMITS OF SAID MUNICIPALITY; PROVIDING
FURTHER FOR AUTHORITY TO CODIFY, REPEALING
PROVISIONS, SAVINGS CLAUSE, PENALTY PROVISIONS,
AN- EFFECTIVE DATE AND FOR OTHER PURPOSES.
PREAMBLE
This ordinance is deemed to be an e~_a~ergency measure
enacted for the immediate preservation of the public peace, property, health
and safety of the inhabitants of the City of Boynton Beach, Florida, and for
the efficient dally operation of lhe mumcipal Police Department.
Section 1.~ The provisions of Section 29-3 of the Codified
Ordinances of the City of Boynton Beach be and the same are hereby amended
lo read:
Sec. 29-3.
Railroads - Speed limit of trains.
(a) Regulated. It shall be unlawful for any person, firm or
corporation to operate any train, either of passenger cars or freight cars, or
both, drawn by one or more locomotives, driven by diesel or steam power or
otherwise, or any other Type of railway vehicles, other than those set forth in
Sec. 29-3.1 of this Code of Ordinance, upon railway tracks within the corporate
limits of the City of Boynton Beach, Florida, at a speed in excess of 15 miles
per honr.
(b) Pe:~alty. Any person, firm or corporation convicted of vi~)l-
aiin~ the provisions of this section shall be punished by a fine not exceeding
$500.00 or by imprisonment for a period of not exceeding ninety days or botk,
such fi~e and imprisonment.
Section 2: Separability: Each of the provisions of this Ordinance
are separable, including word, clause, phrase or sentence, and if any portion
hereof shall be declared invalid, the remaining portion shall not be affected
but shall remain in full force and effect.
Section 3: Authority to Codify: Specific authority is hereby
granted to codify and incorporate this Ordinance in the City's existing Code.
Section 4: Repealing Provisions,:. All ordinances or parts of
ordinances in conflict herewith are hereby repealed.
Section 5: Effective Date: This Ordinance shall become
effeclive in the manner and at the time provided in the charter and ordinance~
of the City of Boynton Beach, Florida.
