AN EMERGENCY ORDINANCE OF THE CITY OF BOYNTON
BEACH, FLORIDA, CALLING A SPECIAL ELECTION FOR
SUBMISSION TO THE QUALIFIED ELECTORS OF SAID CITY
THE QUESTION OF THE ISSUANCE, TERMS AND CONDITIONS
OF TWO MILLION SIX HUNDRED THOUSAND ($2,600, 000.00)
DOLLARS IN GENERAL OBLIGATION. STORM DRAINAGE
BONDS BY SAID CITY; PROVIDING FURTHER FOR SAVINGS
CLAUSE, REPEALING PROVISIONS, A~ EFFECTIVE DATE
AND FOR OTHER PURPOSES.
PREAMBLE
This Ordinance is deemed to be an emergency measure,
er_acted for the immediate preservation of the health,
safety and welfare of the inhabitants of the City of Boynton
Beach, Florida, to enable said City to construct needed
facilities to provide for proper and adequate storm drainage
within said City.
E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEAC
FLORIDA:
Section 1: That the City of Boynton Beach, Florida, shall issue
~eneral obligation bonds m an aggregate principal amount not exceeding Two
~illion Six Hundred Thousand &lfo/100 ($2,600, 000.00) Dollars, bearing
,nterest not exceeding,~|)~ (~ percent per annum from date of issuance, and
nainring n~ later than~) j~ears from date of issuance, for the purpose of
'inancing the cost of a major storm drainage system withiu ~id City, together
vith necessary costs and expenses appertaining thereto. The full faith and
;redit of the City of Boynton Beach, Florida, shall be pledged for the payment
the principal of and interest on said bonds, and ad valor?em Taxes shall be
cried without limit as to rate and amount for the payment of the principal of
md interest on said bonds on all taxable property in said City.
Section 2: None of said bonds shall be issued as provided in
;ection 1 hereof until and unless the issuance thereof shall have been first
Lpproved by the qualified electors of the City, in the manner provided by the
]onstilution and Slam,es of the State of Florida and the Charter of the City of
$oynton Beach, Florida, voting at the special election hereinafter provided for.
Section 3: ~- special election is hereby called, to be held on the
day of ~J ~- A.D. 1971, to determine whether or not the issuance of
said bonds shall be approved by the qualified electors of the City in the
manner provided in the Constitution and the Statutes of the State of Florida
and the Charter of the City of Boynton Beach, Florida. Notice of said Special
Election shall be given by publication of the contents of this Ordinance in the
Boynton Beach News Journal once each week for four (4) consecutive weeks
prior to said election, with,the first publication to be-at least thirty (30) days

City Clerk and at other conspicuous places within the City, at least thirty
(30) days prior to the date of said Special Election.
Section 4: The City Council shall have prepared and furnish all
necessary ballots and shall arrange for said voting to be conducted on
appropriate voting machines and shall make all other necessary preparations
for said Special Election and shall pay the Clerks and Inspectors hereinafter
provided for and all expenses of said Special Election, out of funds provided
~herefor by the City. The form of ballot to be used at said Special Election
shall be in substantially the following form:

Shall the City of Boynton Beach, Florida, issue not exceeding

Dollars general obligation bonds of said City, bearing interest

issuance, and maturing not later than ~o years from date of
issuance thereof, for the purpose of financing the cost of
construction of a major storm drainage system in said City, and
f~o levy ad valorem taxes on alt taxable property in the City
without limit as to rate and amount, for the payment of the
principal of and interest on said bonds, all as provided for ~n
Ordinance No. 71-10, adopted by the City Council of the City
of Boynton Beach, Florida, on the 16th day of April, 1971.

Section 5: Paper ballots shall be used in said election for
absentee voters. The form of ballots to be prepared by the City Clerk for
absentee voters shall be substantially in the form set forth in Section 4 herein~
above, except instructions to voters contained thereon shall read as follows:

Section 6: All qualified electors of the City of Boymton Beach,
Florida, shall be entitled to vote in said Special Election. The City Clerk
shall furnish to the Inspectors and Clerks at every voting place a certified
copy of the list of qualified electors of the City, in the manner provided in the
general election laws of the State of Florida.
Section 7: The City Council, at leas$, six (6) days before the date
of said Special Election, shall appoint for each election district of the City at
least two (2) Inspectors and a Clerk of Election, to hold said election in the
several districts of the City, and such appointment shall be recorded in the
minutes of the City Council. If any inspector or clerk of election so appointed
shall fail to attend at the proper polling place at the time for opening of the
on the day of the election, those inspectors present shall fill the vacancy or
vacancies from the qualified electors present; and if all the inspectors be
absent, then those persons qualified to vote at said Special Election shall fill
the vacancies. The polls shall be opened at 7:00 o'clock A.M. and close at
7:00 o'clock 10. M., and shall be located at, or as near as possible to the

polling places used in the last CityGeneral Election. The inspeczors and
clerks of the election in each election district shall make out and sign
duplicate returns of said Special Election and shall deliver one copy thereof to
the City Clerk and one copy to the City Council of the City. Said City Council
shall, as soon as practicable, canvass and declare, from said returns of the
inspectors and clerks of said election, the result of said Special Election on
the question of the approval of said issue of bonds, and shall make and enter
in their minutes a finding as to the total number of vozes cast in said Special
Election in favor of the issuance of said bonds and levy of taxes for payment
thereof and the total number of votes cast in said Special Election against the
issuance of said bonds and levy of ~axes for payment thereof. Said Special
Election shall in all other respects be held in accordance with the General
Election Laws of the State of Florida.
Section S: Separability: Each of the provisions of'this Ordinanc
are separable, including word, clause, phrase or sentence, and if any portio~
hereof shall be declared invalid, the remaining portion shall not be affected,
but shall remain in full force and effect.
Section 9: Repealing Provisions: All ordinances or par~s of
ordinances in conflict herewith are hereby repealed.
Section 10: Effective Date: This Ordinance is deemed to be an
Emergency measure and shall take effect immediately upon passage.
PASSED AND ADOPTED on first reading at a Special Meeting of
the City Council of the City of Boynton Beach, Florida, held on the 16th day
April, A.D. 1971.
