O71-09 OR DINAN.C__E_NO. 71-9_- AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, LEVYING SPECIAL ASSESSMENTS AGAINST PROPERTY BENEFITED BY A CERTAIN STREET RVIPROVEMENT PROJECT WITHIN THE SAID CITY, TO WIT: THAT PORTION OF N. E. 7th AVENUE, LYING BETWEEN TIlE SOUTHERLY EXTENSION OF THE WEST LINE OF LOT 14, BLOCK 1, BOYNTON PLACE, AND THE EASTERLY RIGHT-OF-WAY LINE OF N. E.. ?TH STREET, CONSISTING OF APPROXIMATELY 810 LINEAL FEET. RECITING BY WHAT METHOD SAIl) SPECIAL ASSESSMENT IS-MADE AND THE TIME WHIDN ~[A1VIE SHALL BECOME PAYABLE, PROVIDING FOR T~ METHOD OF COLLECTION THEPdEOF, AND FOR'OTHER PURPOSES WHEREAS, pursuant to the provisions of Section 160 of the Charter of the CITY OF BOYNTON BEACH, FLORIDA, ~he City has hereto- fore caused a certain public street to be constructed over the property more particularly described as: That portion of N.E. 7ih Avenue, lying between the southerly exlension of the west line of Lot 14, Block 1, BOYNTON PLACE, and the easterly right-of-way line of N.E. 7th Street, consisting of approximately 810 lineal feet; and WHEREAS, the City Clerk has heretofore compiled an assess- ment roll showing the lots and land assessed to pay the cost thereof in connection with subject improvemenz and the amounl of assessment as to each such lot or land, which said roll has heretofore been approved by the City Council; and WHEREAS, proper legal notice of the approval of said roll has been given and a public hearing held relative thereto, al which time no objections were made, or if objections were made, same were deemed sufficient by the City Council; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: That the special assessment roll covering the above-described project, a true copy of which is attached herelo and hereby made a part hereof, is hereby ratified, approved and confirmed, and the amounts indicated for each lo~ or parcel described therein are hereby levied against same as a special improvement assessment and same shall constitute liens against said land as of the effective dale of this Ordinance, each of said parcels along subject improvemenf having been assessed on a front footage basis, charging each parcel its proportionate share by dividing its respective front footage into the total improvement cost. Section 2: Each property owner shall have the privilege of paying the entire assessment as to his proper~y within ninety (90) days from the attachment of said lmprovemen~ lien without penalty. If any owner fails to pay said lien within said ninety (90) day period, it shall De paid in three consecutive equal installments, payable as other ad valorem taxes are paid, commencing with tax year 1971, together with interest at the rate of 8% per annum from the ~late of ailachment of said lien on the unpaid balance thereof. Section 3: Separability: Eae~qf~ttie ~r~visio~sL~>~ this Or~t~e~are separable, including word, clause, phrase, or sentence, and if any portion here~ shall be declared invalid, the remaining portion shall not be affected, but shall remain in full force and effect. Section 4: l~epealing Provisions: All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 5: Effective Date: This Ordinance shall become effective in the manner and at the time provided in the Charter and Ordinances of the City of Boynton Beach, Florida.
