R91-161RESOLUTION NO. R9I-/~/ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING RESOLUTION NO. R91-31, TO INCREASE RECREATION FEES AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Boynton Beach, Florida deems it necessary to set forth uniform fees and policies for the use of its recreation facilities and parks; and WHEREAS, due to financial considerations it has become necessary to increase various fees; NOW, THEREFORE, BE IT RESOLVED BY THE CITY CO~4ISSION OF TBE CITY OF BOYNTON BEACH, FLORIDA THAT: Section 1. Resolution No. R91-30, shall be amended by adding a new Exhibit "A" attached to and incorporated herein, increasing various recreation fees. Section 2. REDU~ED~K~_q Effective October 1, 1991, "non-resident fee~' will be termed "regular fees" and "resident fees" will be termed "special reduced fees" for residents. Regular fees for non-residents will be a minimum of 25% above the special reduced fee for residents, with a minimum charge to non-residents of $3.00 above the special reduced fee for progr~ams and services priced under $ 2.oo. 2) F~ CLASSIFICATION Fees charged for programs, facilities and services provided shall be classified as: a) rental fees b) special service fees c) permit fees d) admission, entrance and parking fees e) user fees f) sales RENTAL FK~q will be charged for the privilege of exclusively using tangible public proper~y or 'building structures without consuming or injuring them in any way~ Examples include picnic items, sports equipment, booth rentals as well as.facility room rentals. SPECIAL SERVICE F~w-q will be charged for supplying_extraordinary articles, commodities, activities, materials, or services as an accommodation to the public which are not provided as part of the Department's basic, free public services. Examples include birthday party services, keys, field preparation, lights, staff, custodial and processing fees. PEI~fIT MK~_q will be charged for permission or written authorization for a specified lawful action or use of a facility. Examples include picnic shelters, sports leagues, tournaments, filming/photography, and special event vending. Vending and exhibitor permits may be required for certain special events. ADMISSION FEES may be charged to enter a building or structure. These facilities usually offer an exhibit, show, performance, concert, ceremony or demonstration. Examples include attending special performances or events which require high cost talent, specialists, technicians, equipment, extra supervisory and maintenance personnel or Where the net revenue generated is used to offset the program or facility costs. Parking fees may be charged at designated parks for daily, weekend and holidays to control overcrowding and subsequent damage to greenways and roadways, to minimize vandalism, provide additional patron safety, or to offset a portion of park operational costs. USER FEES may be charged for the use of a high cost facility or participation in an activity. The patron usually enjoys the privilege of use with others. Examples include instructional classes, trips, tours, camps, sports clinics, workshops, launch ramp/marina fees, administrative, publicity and promotion fees. SALES - Unconditional ownership of merchandise which passes from the Department to the user will be sold to the user. Examples include arts and crafts supplies, merchandise related to programs and services offered, and departmental tabloid, bulletin, newsletter,, or program advertising space. 3) DJ~]~qTIAL ~Kmq tn addition to fees differentiated according to residency, fees for programs, services and facilities may be differentiated according to the financial objectives of the following organizations: Commercial/Profit Fundraising Non-profit Private/Family Schools Religious Fee Exempt Examples include facility rentals for private/commercial gain, non profit group meetings, family celebrations. The Director of Recreation & Parks shall esta- blish the fee for the above organizations based upon the following fee schedule.
