A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA,
AUTHORIZING EXECUTION OF TWO REVISED
AGREEMENTS FOR THE MAINTENANCE OF
TRAFFIC CONTROL DEVICES ON THE AT-GRADE
RAILROAD CROSSINGS FOR NE 22~) AND 15TH
AVENUES; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the attached two Agreements previously came before the
Commission and were approved by Resolution Nos. R01-242 and R01-243, on August
21, 2001, however FDOT erroneously prepared the Agreements on out-dated forms,
which wereremmed by the Comptrollers Office in Tallahassee for re-signature;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY Oli BOYNTON BEACH, FLORIDA. THAT:
Section 1. The City Commission of the City of Boynton Beach, Florida does
~ereby authorize execution of two revised Raikoad Reimbursement Agreements with the
State of Florida Department of Transportation and the FEC Railway Company for the
installation and maintenance of certain grade crossings and traffic control devices for
grade crossings designated as Finance Project ID 41018215701 and Finance Project ID
41018315701, on N.W. 22nd Avenue and 15th Avenue, which crosses the fight of way and
~racks of the FEC Railway Company at FDOT/AAR Crossing No. 272476-Y, and at
FDOT/AAR Crossing No. 272484-R, respectively, located in Boynton Beach;Florida.
Section 2. That the City assumes its share of the costs for future maintenar/ce
and/or adjustment of said grade crossings and traffic control devices for grade crossings
as designated in the Railroad Reimbursement Agreement.
.Section 3. That the Mayor and City Clerk are hcreby authorized to execute
such revised Agreements with the State of Florida Department of Transportation and the
FEC Railway Company.
Section 4. That this Resolution shall take effect immediately upon passage.
