AN ORDINANCE OF THE CITY OF BOYNTON
BEACH, FLORIDA, REGARDING THE
APPLICATION FOR REZONING BY DAKOTA
LOFTS; AMENDING ORDINANCE 91-70 OF
SAID CITY BY REZONING A TRACT OF
LAND MORE PARTICULARLY DESCRIBED

COMMERCIAL AND R-l-AA SINGLE-FAMILY
RESIDENTIAL TO PLANNED UNIT
DEVELOPMENT (PUD); PROVIDING FOR
CONFLICTS, SEVERABILITY, AND
EFFECTIVE DATE.
WII~REAS, the City Commission of the City of Boymon Beach, Florida has
adopted Ordinance No. 91-70, in which a Revised Zoning Map was adopted for said
City; and
WHEREAS, H.P. Tompkins, as agent Chan's Enterprises, owner of the property more
y described hereinafter, has heretofore filed a Petition, pursuant to Section 9
A-Zomng, of the Code of Ordinances, City of Boynrnn Beach, Florida, for
g a certain rraet of land consisting of 2.00 acres, said land being
more particularly described hereinai2er, from C-3 Community Commercial and R-i-AA
Single-family Residential ro Planned Unit Development (pUD); and
WHEREAS, the City Commission deems it in the best imerests of the
said City to amend the aforesaid Revised Zoning Map as hereinafter set
NOW, T}H~REFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
I~HE CITY OF BOYNTON BEACH, FLORIDA, THAT:
S_action 1: The following described land, located in the City of Boynton Beach, Florida
as set forth as follows:
See attached Exhibit "A' '
and the same is hereby rezoned from C-3 Community Commercial and R-l-AA Single-
~ Residential to Planned Unit Development (pUD). A location map is attached hereto as
"B" and made a part of this Ordinance by reference.
S_e. ction 2: That the aforesaid Revised Zoning Map of the City shall be amended
Sectign 3~.' All ordinances or parts of ordinances in conflict herewith are hereby

S__ection 4__2.' Should any section or provision of this Ordinance or any portion thereof
by a court of competent jurisdiction to be invalid, such decision shall not affect the

S~ection 5_.' This ordinance shall become effective immediately upon passage.
