R91-/~ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A SECOND AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF BOYNTON BEACH AND REYNOLDS ALUMINUM RECYCLING COMPANY, A COPY OF SAID AMENDMENT NO. 2, BEING ATTACHED HERETO AS EXHIBIT "A"; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the ~luminum Recycling 22, 1986; and City of Boynton Beach and Reynolds Company entered into an Agreement on May WHEREAS, it has been deemed by the City Commission of the City of Boynton Beach to be in the best interests of the residents of the City of Boynton Beach to execute the said ~mendment No. 2 to the original Agreement, which would Dxtend the hours of operation as well as provide a $500.00 ~onthly fee to the City as reimbursement for the City's cost Df providing and servicing a rolloff recycling container for the purpose of collecting used newspapers. A copy of said ~mlending No. 2 is attached hereto as Exhibit "A"; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION DF THE CITY OF BOYNTON BEACH, FLORIDA THAT: Section 1. The City Commission of the City of Boynton Beach, Florida hereby authorizes the Mayor and City 21erk to execute a certain Amendment to the Agreement between the City of Boynton Beach ~hd~ Reynolds Aluminum Recycling Company, which Amendment is attached hereto as Exhibit "A" and made a part hereof. Section 2. This Resolution immediately upon passage. shall take effect PASSED AND ADOPTED this ~ day of August, 1991. ~TTEST: (Corporate Seal) ~UThS I G [bOC ~CYCLING.7/3t~9~ CITY OF BOYNTON BEACH, FLORIDA Mayor AMENDMENT NO. 2 DATED AuKust 6, 1991 TO THE AGREEMENT BETWEEN THE CITY OF BOYNTON BEACH, FLORIDA AND REYNOLDSALUMINUM RECYCLING COMPANY DATED MAY 22, 1986. Pursuant to the terms of that certain agreement, entered into on the 22nd day of May, 1986, between THE CITY OF BOYNTON BEACH (CITY) AND REYNOLDS ALUMINUM RECYCLING COMPANY (REYNOLDS), the CITY and REYNOLDS agree to amend Section 5 of the original Agreement to read as follows: "Section 5. REYNOLDS shall operate Saturdays during the hours of 9:30 AM - 5:00 PM, exclusive of major holidays, notice of which shall be conspicuously posted by Reynolds at the Center at least one week in advance. The operating hours may be changed upon mutual agreement by both REYNOLDS and the CITY, providing at leas~ thirty (30) days elapsed time for public notification of such change." A new section 11. shall be added to the original agreement to read as follows: "REYNOLDS shall remit to the CITY a monthly fee of Five Hundred Dollars ($500) as reimbursement for the City's cost of providing and servicing a rolloff recycling container for the purpose of collecting used newspapers." Ail 22, 1986 adopted. IN WITNESS WHEREOF, Amendment to be executed the site Tuesdays through 12:00 NOON and 12:30 other provisions contained in the Agreement dated May shall remain in full force and effect as originally the parties have hereunto caused this by their duly authorized officials.
