A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AUTHORIZING THE MAYOR AND CItY CLERK TO
EXECUTE AN EASEMENT AGREEMENT BETWEEN
THE CITY OF BOYNTON BEACH AND FLORIDA
POWER & LIGHT; A COPY OF SAID AGREEMENT
IS ATTACHED HERETO AS EXHIBIT "A"; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, City Commission at the recommendation of staff, has
determined it to be in the best interests of the citizens and
residents of the City of Boynton Beach, to execute a certain
Easement Agreement, attached hereto as Exhibit "A".
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1. The City of Boynton Beach hereby
authorizes the Mayor and City Clerk to execute an Easement
Agreement between the City of Boynton Beach and Florida Power &
Light, which Agreement is attached hereto as Exhibit "A".
Section 2. This Resolution shall take
immediately upon passage.

The undersigned, in consideration of the payment of $1.00 and other good and valuable considera-
tion, the adequacy and receipt of which is hereby acknowledged, grant and give to Florida Power &
Light Company, its licensees, agents, successors, and assigns, an easement forever for the construc-
tion, operation and maintenance of overhead and underground electric utility facilities (including
wires, poles, guys, cables, conduits and appurtenant equipment) to be installed from time to time:
with the right to reconstruct, improve, add to, enlarge, change lhe voltage, as well as, the size of and
remove such facilities or any of them within an easement 10 feet in width described as follows:
& 10 foot wide FPL Company easement lying in a portion of Section 23, Township 45
South, Range 42 East, Palm Beach County, Florida; the South line of said 10 foot
wide easement being more particularly described as follows:
Commencing at the south quarter corner of said Section 23; thence run North 00o26'54''
East along the west line of the southeast one-quarter (SE 1/4) of said Section 23
for a distance of 98.69 feet; thence South 88008'50'' East, 70.02 feet to the Point-
of-Beginning; thence continue South 88008'50'' East along the north additional
Right-of-Way line of Boynton Beach Blv (SR 804) for a distance of 163.37 feet co
the beginning of a curve concave to the North, having a radius of 13,204.56 feet
and a central angle of 01°52'22"; thence run Easterly along the arc of said curve
for a distance of 431.60 feet to the Point-of-Termination.
Together with the fight to permit any other person, firm or corporation to attach wires to any
facilities hereunder and lay cable and conduit .within the easement and to operate the same for
communications purposes; the right of ingress and egress to said premises at all times; ~ir~:ttight
~j~xek~J~Oxkt,~~at~, undergrowth and other obstructions within the
easement area; to trim and cut and keep trimmed and cut all dead, weak, leaning or dangerous
trees or limbs outside of the easement area which might interfere with or fall upon the lines or
systems of commumcations or power transmission or distribution; and further grants, to the full-
est extent the undersigne~d has the power to grant, if at ail. the rights hereinabove granted on
the land heretofore described, over. along, under and across the roads, streets or highways ad-
joining or through said property.
