WHEREAS, the City Commission of the City of Boynton
Beach, Florida, approved an award of bid to Tare Landscape
on the 16th day of April, 1991;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1. The City of Boynton Beach, Florida
hereby authorizes and directs the Mayor and City Clerk to
execute said Agreement, as attached hereto as Exhibit "A".
Section 2. This Resolution shall take
immediately upon passage.

completed according to this contract, the unit prices shown
immediately hereinafter. It is understood that the quantities shown
are approximate only and may not represent the actual amount of work

ARTICLE II: DURATION OF AGREEMENT:
Work must begin within 10 calendar days from the date of receipt
of official "Notice to Proceed". Contract term shall be one (1) year
from award of contract. Contractor shall maintain landscape areas on
a timely basis, see specifications for detailed scheduling.
ARTICLE III GENERAL:
The Successful Bidder hereby certifies that he has read each and
every clause of the Contract Documents and the he has made such
examination of the location of the maintenance sites as is necessary
to understand fully the nature of the obligation herein made~ and will
complete the same in the time limit specified herein, in accordance
with the plans and specifications.
All work under this contract shall be done to the satisfaction of
the Superintendent of Parks, who shall, in all cases, determine the
amount, quality, fitness and acceptability of the work, materials,
supplies, which are to be paid for hereunder, and shall decide all
questions which may arise as to the fullfillment of the Contract on
the part of the Bidder; and his decision thereon shall be final and
conclusive; and such determination and decision, ~n case any questions
shall arise, shall be a condition precedent to the right of the Bidder
to receive any money hereunder.
Any clause or section of this contract or specification whick
may, for any reason, be declared invalid, may be eliminated therefrom;
and the intend of this contract and the remaining portion thereof will
remain in full force and effect as completely as though such invalid
clause or section has not been incorporated therein.

ARTICLE V: PAYMENTS:
Vendor shall submit a monthly invoice the first of each month,
itemizing all maintenance items performed the previous month. A
schedule of all maintenance items to be performed the following month,
shall be submitted with the invoice noting dates, times, and locations
of operations. The Parks and Recreation Departments must b notified
prior to any change in scheduling within five (5) working days to
allow City staff to inspect sites for scheduled maintenance. Written
reports must be turned into the Parks and Recreation Department after
each mowing operation on a check list to be provided to the awarded
vendor by the City. The Vendors Federal Identification Number must be
noted on the Bid in order for payment to be processed by the City.

ARTICLE VIII: INSPECTION AND EXAMINATION
The Park Superintendent and his authorized assistants shall have
free access to the work at all times for inspection purposes for
ascertaining whether the work being performed or which has been
completed is in accordance with the requirements of the specifications
and Contract. In case any dispute arises between the Bidder and the
Park Superintendent as to materials furnished or the manner of
performing the work, the Park Superintendent shall have authority to
reject materials or suspend the work and shall be made satisfactory as
directed by the Parks Superintendent.
ARTICLE X: CONTRACT PRICE
The Owner shall pay the Bidder as just compensation for the
performance of this agreement, subject to any additions or deductions
as provided in the Specification Documents for the following unit and
lump sum prices.
SIXTY-SEVEN THOUSAND NINE HUND~RDNINETY-FOUR DOLLARS AND 00/100
$67, 994.00
The undersigned Bidder agrees that he has carefhlly inspected
the site of the work and is thoroughly familiar with all conditions
therein. The Bidder further agrees to commence work within 10
calendar days after date of "Notice to Proceed" and shall complete the
work within the time limit as follows:
Term of contract shall be one (1) year from dated of contract.
