R91-035 RESOnUTION NO. A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING A FIRST AMENDMENT TO BE PREPARED TO THE CONTRACT BETWEEN THE CITY OF BOYNTON BEACH AND GEE & JENSON TO PROVIDE FOR PRELIMINARY DESIGN PHASE, FINAL DESIGN PHASE AND BIDDING/AWARD PHASE OF THE BDBG-FUNDED PROJECT; AND AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE THE SAID FIRST A/~ENDMENT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on February 5, 1991, by Resolution No. R91-23, the City Commission approved an agreement between the City of Boynton Beach and Gee and Jenson to retain that engineering firm to provide for preliminary design phase, final design phase, and bidding/award phase of the CDBG funded projects for the area including NE llth, 12th and 13th Avenue between Seacrest Boulevard and the FEC Railway; and WHEREAS, the Agreement was forwarded to The Housing and 2ommunity Development Department of Palm Beach County for review and the City has been advised that the following amendments must be included in the Agreement: 1.) The addition of Railroad Avenue in the scope of work; and 2.) The hourly rate schedule of Palm Beach County for consulting engineers for HCD projects be accepted and adopted; and WHEREA$~ the City of Boynton Beach and Gee and Jenson are amenable to entering into a First Amendment of the Contract to incorporate the Housing and Community Development Department changes, NOW, THEREFORE, BE IT RESOLVED BY THE CITY CO~ISSION OF THE CITY OF BOYNTON BEACH, FLORIDA THAT: Section 1. The "WHEREAS" clauses are hereby ratified and confirmed as being true and correct. Section 2. The City Commission hereby authorizes and directs the City attorney to prepare a First Amendment to the Contract between the City of Boynton Beach, Florida and Gee and Jenson to include the two provisions set forth %ereinabove. Section 3. The Mayor and City Clerk are hereby authorized and directed to execute a certain First Amendment to the Contract between the City of Boynton Beach, Florida and Gee and Jenson as provided for in Section 1 hereof. Section 4. This Resolution shall take effect immediately upon passage.
