A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE A CERTAIN SERVICE CONTRACT
BETWEEN THE CITY OF BOYNTON BEACH,
FLORIDA AND HARDRIVES, INC., FOR THE
SALE AND REMOVAL OF LIME SLUDGE AT THE
WATER TREATMENT PLANT LOCATED AT 162~ S.
SEACREST BOULEVARD; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton
Beach has deemed it to be in the best interest of the
citizens and residents of the City of Boynton Beach to enter
into a Service Contract between the City of Boynton Beach
and Hardrives, Inc., for the sale and removal of lime sludge
at the Water Treatment Plant, located at 1620 S. Seacrest
Boulevard; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1. The Mayor and City Clerk are hereby
authorized and directed to execute said Service Contract, a
copy of which is attached hereto as Exhibit "A".
Section 2. Said Resolution shall take effect
immediately upon passage.

SERVICE CONTRACT
This agreement dated 5th day of February ,19 91
by and between the CITY OF BOYNTON BEACH, PALM BEACH COUNTY, FLORIDA,
hereinafter called the Owner, and HARD~IVES~ INC.
(a corporation organized and existing under the laws of the State of
FLORIDA ) and hereinafter called the Contractor.
WITNESSE~: The Owner and the Contractor, for the consideration
stated herein, agree as follows:
ARTICLE I: SCOPE OF WORK
The Contractor shall perform all required work and shall provide
and furnish all labor, materials, necessary tools, expendable equipment
and all utility and transportation services required to

all in strict accordance with the specifications, including any and all
Addenda, and in strict compliance with the Specification documents
hereinafter enumerated.
It as understood and agreed that said labor, materials, tools,
equipment and service shall be furnished and said work performed and
completed under the direction and supervision and subject to the
approval of the Owner or its authorized representative. However, the
Contractor shall retain his identity as an independent contractor and
no wise shall be considered an agent of the Owner.
ARTICLE II: CONTRACT PRICE
The Contractor shall pay the Owner as just compensation for the
LIME SLUDGE as provided in the Specifications Documents for the
following unit prices.
The Contract amount is One Dollar and Seventy-six Cents/Price per
Cubic yard of Lime Sludge ($1.76) based upon unit lump sum prices
herein contained. The undersigned Bidder agrees that he has care-
fully inspected the site and is thoroughly familiar with all
conditions therein. The Bidder further agrees to commence removal
within twenty-four (24) hours after notification.
IN WITNESS WHEREOF, The parties hereto have caused this agreement
to be executed as of the day and year first above-written, in two (2)
counterparts each of which shall for all purposes be deemed an
original.
