2 A RESOLUTION OF THE CITY OF BOYNTON
3 BEACH, FLORIDA, APPROVING AND
4 AUTHORIZING THE DEMOLITION OF THE
5 STRUCTURE LOCATED AT 1101 — 1103 NORTH
6 FEDERAL HIGHWAY; AND PROVIDING FOR AN
7 EFFECTIVE DATE.

9 WHEREAS, on March 2, 2020, the Building Board of Adjustment and Appeals
10 ("Board")approved the Building Official's determination that 1101-1103 N.Federal Highway
11 ("Subject Property) be demolished due to a finding that the structure was unsafe pursuant to
12 Section 116 of the Boynton Beach Administrative Amendments to the Florida Building Code
13 (BB AA FBC); and
14 WHEREAS, the testimony provided by the Building Official at the hearings included
15 information that prior repairs were made without obtaining permits from the City, existing
16 exposure to weather conditions, water intrusion decay, collapsing ceiling drywall, roof
17 deficiencies,wood-borne organisms,and fire hazard concerns relating to exposed wires; and
18 WHEREAS, in preparation for demolition, the Building Department complied with
19 notice requirements in accordance with Section 116 of the BB AA FBC;and
20 WHEREAS, the City Commission of the City of Boynton Beach deems it to be in the
21 best interest of the Citizens and residents of the City of Boynton Beach to approve and authorize
22 the demolition of the structure located at 1101 — 1103 North Federal Highway,Boynton Beach.
23 NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
24 THE CITY OF BOYNTON BEACH,FLORIDA,THAT:
25 Section 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
26 being true and correct and are hereby made a specific part of this Resolution upon adoption.

27 Section 2. The City Commission hereby approves and authorizes the demolition of the
28 structure located at 1101 — 1103 North Federal Highway,Boynton Beach,Florida.
29 Section 3. That this Resolution shall become effective immediately.
30 PASSED AND ADOPTED this CQ day of April,2021.
