A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
DELETING AND RESCINDING RESOLUTION
90-GGGGG IN ITS ENTIRETY; AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, on August 7, 1990, the City Commission of the
:ity of Boynton beach, Florida passed and adopted Resolution
No. 90-GGGGG, which Resolution changed the name of the
streets in the Estate of Silverlake; and
WHEREAS, the City Commission has since been advised by
the President for Silverlake Board of Directors that the
majority of property owners of Silverlake have rejected the
change by written ballot.
NOW, THEREFORE, BE IT RESOLVED ~¥ THE CITY COMMISSION
OF THE CITY OF B~N BEACH, FLORIDA.
Section 1. That the City Commission of the City of
Boynton Beach, Florida does hereby rescind and delete
Resolution 90-GGGGG in its entirety.
Section 2. That this Resolution shall take effect
immediately upon passage.

This agreement is made this 15th day of November, 1990, by and
between The Hamlet, Ltd., a Florida limited partn'ership (the "Hamlet"); and the City
of Boynton Beach, a Florida municipal corporation CBoynton").
Whereas the acquisition of the land for the Boynt0n Bay development in
Boynton has not yet been finalized; and
Whereas, Hamle! wishes Boynton to continue with the permitting
process to expedite commencement of site work and construction as soon as such
acquisition has been finalized; and
Whereas Boynton requires a deed from Hamlet dedicating a 60-foot fight
of way for Northeast 4th Street through the property being acquired by Hamlet.
Now, therefore, for and in consideration of the mutual covenants
contained herein, the parties hereto do hereby agree as follows:
The foregoing recitations are ratified, confirmed and incorporat&l.
Boynton shall hold in escrow the attached deed from Hamlet to
Boynton, conveying said 604oot fight of way for Northeast 4th
Street;
Boynton shall continue processing applications of Hamlet with
respect to the permitting process to facilitate issuance of permits
requested on the date of acquisition of said land by Hamlet, or
shortly thereafter;
Upon notification and proof of acquisition of the 23.835 acre parcels
of land for the goynton Bay development by Hamlet, Boynton shall
record the attached deed.
Boynton as escrow agent shall not be liable for any mistakes of fact
or error of judgment or for any acts or omissions of any kind unless
caused by its willful misconduct or gross negligence.
6. Boynton shall not be entitled to any fee for the performance of its
duties under this agreement.
Boynton may issue building and/or land development permits based
upon the conveyance referred to in this agreement. In the event the
23.835 acres are not conveyed to Boynton within 60 days of this
agreement, such building and/or land development permits shall be
null and void.
