90-FFFFFFRESOLUTION NO. 90- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE A CERTAIN AGREEMENT BETWEEN THE CiTY OF BOYNTON BEACH, FLORIDA AND DISTRICT BOARD OF TRUSTEES OF THE PLAM BEACH COMMUNITY COLLEGE~ A COPY OF SAID AGREEMENT BEING ATTACHED HERETO AS EXHIBIT "A"; AND PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT RESOLVED by the City Commission )f the City of Boynton Beach, Florida, that: Section 1o The Mayor and City Clerk are hereby authorized and directed to execute a certain Agreement between the City of Boynton Beach and the District Board of Trustees of the Palm Beach Community College to enter into a contractual arrangement providing for the education and ~raining of students in the Paramedic Program. Section 2. This Resolution shall take effect immediately upon passage. PASSED AND ADOPTED this ~ day of September, 1990. ATTEST: (Corporate S~al)., C6mmissioner AGREEMENT THIS AGREEMENT, made and entered into by and between the DISTRICT BOARD OF TRUSTEES OF THE PALM BEACH COMMUNITY COLLEGE, ~ public corporation under the laws of the State of Florida, hereinafter referred to as "THE BOARD" and the CITY OF BOYNTON BEACH, hereinafter referred to as "THE CITY", W I T N E S S E T'H: WHEREAS, the parties hereto desire to enter into a contractual arrangement providing for the education and training of students in the Paramedic Program, and WHEREAS, the City of Boynton Beach Fire Department shall be referred to herein as "THE DEPARTMENT." NOW, THEREFORE, it is agreed between the parties hereto as follows: 1. THE BOARD, through its facilities at the Palm Beach Community College, has undertaken to educate and train students in the Paramedic Program. 2. THE DEPARTMENT agrees not to begin any training programs in the Paramedic field, conducted by the College while-this agreement is in effect, without the prior consent of THE BOARD. 3. The program shall be in the Division of Education and Social Science. 4. The control of the program shall reside in the President of Palm Beach Community College with the assistance of the Chairperson of the Education and Social Science Division. There shall be established an Advisory Committee who will counsel the said President and Division Chairperson responsible for the program. 5. THE DEPARTMENT and THE CITY shall not be liable for the acts or omissions of students participating in the Paramedic program, while participating in a clinical experience with THE DEPARTMENT. The College shall not be liable for the acts or omissions of City employees, which may occur while students are participating in the paramedic/clinical experience with THE DEPARTMENT. Page 2 6. This Agreement shall continue for two (2) years from the date hereof unless sooner terminated as hereinafter provided and may be renewed at the end of two (2) years by the mutual consent of the parties hereto. In the event that either party desires to terminate the arrangement prior to the two (2) year period, notice is to be given by the party desiring to terminate to the other party mn writing, but such termination shall not be effected until such time as all then enrolled students have had an opportunity to complete their prescribed program, although new enrollees shall not be accepted after receipt of notice of termination. FURTHER, THE BOARD agrees to: 1. Accept eligible students in the program as regular enrollees the Palm Beach Community College, subject to the rules and ~egulations of of the College. 2. 3. 4. Select a qualified faculty. Provide an approved course of study. Consult with the dasignated person of THE DEPARTMENT mn selecting the clinical expermences for the students of the program. A list of students and their dates of attendance will be provided THE DEPARTMENT by the College. 6. Adhere to the policy and procedures established by said DEPARTMENT. 7. Cooperate with THE DEPARTMENT staff in all matters pertaining to this program. FURTHER, THE DEPARTMENT agrees to: 1. Provide necessary facilities for clinical experiences for proper Paramedic instruction, said facilities having been inspected and found satisfactory by the College faculty prior to this Agreement. 2. Cooperate in the assignment of students in THE DEPARTMENT, such assignments to be made under the supervision of the College faculty. 3. Make possible liaison between the administrator of THE DEPARTMENT and the Chairperson of Education and Social Science Programs. 4, Provide suitable area at THE DEPARTMENT for conferences and group training programs for the students. Provide all health examinations and immunizations required by THE DEPARTMENT other than the basic physical examination and initial immuniza- tions required of emch student upon enrollment. 6. Cooperate in obtaining guesn lecturers from the staff of THE DEPARTMENT upon request of the Division of Education and Social Science Pro- grams. 7. Cooperate with the College staff in all manners pertaining to this program. 8. It is agreed that both parties will require that each Paramedic student at his/her own expense provide the following: a. Meals b. Transportation c. Basic physical examination and immunizations required on enrollment d. Hospital and medical care e. School Accident Insurance or evidence of such insurance protection f. Professional Liability Insurance coverage mn policy limits of $1,000,000 written on m form of policy approved by the parties hereto. Proof of insurance coverage will be provided to THE DEPARTMENT by THE BOARD. Dated this day of September, 1988.
