A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA; REPEALING
RESOLUTION NO. 75-ZZ; DISBANDING THE
MUNICIPAL TENNIS COURTS AND TENNIS CENTER;
PROVIDING FOR RECORDATION; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, on September 2, 1975, the City Commission of the
City of Boynton Beach, Florida recognized the increased demand
for a municipal tennis center; and
WHEREAS, to meet such-need, the City Commission implemented
a municipal tennis court operation plan through Resolution No.
75-ZZ; and
WHEREAS, the tennis center, for the past several years, has
experienced decreased revenue due to falling membership
enrollment and decreased daily play; and
WHEREAS, the City Commission deems it in the best interest
of the citizens and residents of Boynton Beach to disband the
municipal tennis center;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. The foregoing whereas clauses are hereby
ratified and confirmed as being true and correct and are hereby
made a specific part of this Resolution.
Section 2. Resolution No. 75-ZZ is hereby repealed.
Section 3. The tennis center operation is disbanded and
the tennis courts shall be used for free play, on a first come,
first serve basis. All current members of the Tennis Center may
play at the Racquet Center on their currentmembership cards
through September 30, 1990.
Section 4. Ail Resolutions or parts of resolutions in
conflict herewith are hereby repealed to the extent of such
conflict.
Section 5. If any clause, section, other part or
application of this Resolution is held by any Court of competent
jurisdiction to be unconstitutional or invalid, in part or
application, it shall not effect the validity of the remaining
portions or applications of this Resolution.
Section 6. This Resolution shall become effective
immediatly upon its passage and adoption.
